| The public health organizations are part of the public utilities. It obtains the public powers through the "separation of powers" or "authority" of the government. In the primary stage of socialism, the "rent" is an objective existence, and the public health organizations have a "public rights". Under the conditions that the supervision of healthy sector is failure, the supervision of patients is weak, the legal supervision is limited, the social supervision is unprofessional, it is inevitable that the public use the public rights to seek the rents. The commercial bribery comes with rent-seeking activities, and they are twins. Commercial bribery is, in essence, rent-seeking. And the social roots of rent seeking are the collusion between the government and businessmen and the alienation and monopolies of public power. In fact, rent-seeking activities are a corruption of the power that is "the trade between bribe and power". It contains giving,receiving and asking bribes. The purpose is to obtain illegal "rent" and achieves the interests of public power-holders and those who seek the interests. It can be seen that commercial bribery is the main external manifestations of bribes, both twins is a malignant tumor.The author sorts out, summarizes, analyzes, extracts the data, and combines some actual cases. First, the author illustrates the concept of commercial bribery and public health and the public rights, then find the intrinsic link between them, expounds the adverse impact on political, economic and social order, analyses the causes, finally offers some personal responses and recommendations: 1,make up the limitations of existing legislative, perfect the legislative systems; 2,innovative management system and stop "bribe trading"; 3,the introduction of a third party to monitors the doctor's prescription; 4,the foundation of effective incentive mechanism and long effect managing mechanism; 5,create a social atmosphere of faith and build a harmonious business culture.
