Objective:To explore the criminological characteristics, the psychopathological factors & the social function status, and to study the effective factors in the assessment of capacity of criminal responsibility in offenders with mental disorder due to epilepsy.We also expect to gain more understanding about the criminal behaviors in offenders with mental disorder due to epilepsy and provide scientific evidence for the forensic psychiatry assessment in future.Method: Firstly all the samples met the inclusion criteria were collected and registered through the record of forensic psychiatry assessment designed by ourselves, and at the same time assessed the Global Assessment Function score(GAF), Positive And Negative Syndrome Scale score(PANSS)and Social Disability Screening Schedule(SDSS) score.Then the datas were analyzed statisticaly by the computer,with the help of the software SPSS 13.0. Mental disorder due to epilepsy group as the research group and without psychosis group as the control group were divided according to the diagnosis by CCMD-3, and the general demographic datas, the criminological characteristics of them were analyzed by control; For more information in the research group, capacities of criminal responsibility group including partial capacity of criminal responsibility & no capacity of criminal responsibility group were divided according to the different capacity of criminal responsibility,and the related analysis was done by control; The research group was further divided into psychotic symptoms group and personality change group from another perspective, according to the main symptoms which influenced the offenders. Finally, Spearman correlation or Pearson correlation analysis and logistic regression analysis were conducted with the capacity of criminal responsibility as the dependent variable,other related factors as independent variables.Results:Compared with the control group, the research group showed significant differences in the following aspects between thenv.intelligence quotient(IQ)(P=0.000),verbal IQ (P=0.000), performance IQ(P=0.000),the time interval between offence and assessment (P=0.028),offence motivation (P=0.000), preparation before offence (P=0.000), offend smoothly or not (P=0.044), whether anyone was on a patrol duty or not(P=0.000), choose the offending time or date(P=0.000), consideration for the offending time (P=0.000),forgetting all after offence or not(P=0.000),further reaction after offence (P=0.003),offence type(P=0.008) and offence results(P=0.032).Compared with the personality change group, the psychotic symptoms group showed significant differences in the following aspects between them: the time interval between offence and assessment (P=0.001), provocation before offence(P=0.000),offence motivation(P=0.000), offend smoothly or not(P=0.028), offence aim(P=0.000),forgetting all after offence or not (P=0.009),further reaction after offence(P=0.004),GAF score(P=0.000),P item score(P=0.000),N item score (P=0.000),G item score(P=0.000),PANSS total score(P=0.000) and SDSS total score (P=0.000).Compared with no capacity of criminal responsibility group, capacities of criminal responsibility group showed significant differences in the following aspects between themrthe time interval between offence and assessment(P=0.027), provocation before offence(P=0.000), offence motivation(P=0.000), offence aim(P=0.000), forgetting all after offence or not(P=0.009), further reaction after offence(P=0.007),GAF score(P=0.000),P item score(P=0.000),N item score(P=0.000),G item score(P=0.000),PANSS total score(P=0.000) and SDSS total score(P=0.000).The correlation analysis indicated that the assessment of capacity of criminal responsibility correlated with the following twelve relative factors:provocation before offence(r=-0.299), offence motivation(r=-0.464), offence aim(r=-0.439), forgetting all after offence or not(r=0.231), further reaction after offence(r=-0.266),diagnosis(r=0.845),GAF score(r=-0.677),P item score(r=-0.543),N item score(r=-0.482),G item score(r=-0.613), PANSS total score(r=-0. 578) and SDSS total score(r=-0. 369),of which correlated significantly with diagnosis(r=0.845). Finally a logistic regression analysis was conducted with the capacity of criminal responsibility as the dependent variable, 12 related factors as independent variables,which indicated that GAF score(OR=0.325,P=0),G item score (OR=0.837,P=0.003) and diagnosis(OR=3.783,P=0.023) remained in the regression equation.In addition,diagnosis was found a risk factor,while GAF score and G item score were found protective factors.Conclusion: As criminological characteristics were concerned, offence motivation, forgetting all after offence or not, further reaction after offence, could be regarded as the important referring index in the assessment of capacity of criminal responsibility. Compared with the control group, the research group showed significantly lower score in IQ,verbal IQ & performance IQ.The personality change group vs the psychotic symptoms group & no capacity of criminal responsibility group vs capacities of criminal responsibility group, both did not show any significant differences in IQ,verbal IQ & performance IQ, but both showed significant differences in GAF score,P item score,N item score,G item score,PANSS total score and SDSS total score,so more attention should be paid to the contribution of GAF,PANSS & SDSS in the assessment of capacity of criminal responsibility of offenders with mental disorder due to epilepsy. Finally the logistic regression analysis indicated that GAF score, G item score and diagnosis were the main three risk factors in the assessment of capacity of criminal responsibility of offenders with mental disorder due to epilepsy.The psychotic symptoms group & no capacity of criminal responsibility group and the personality change group & capacities of criminal responsibility group,both showed significant consistency, so more attention should be paid to the correct diagnosis in the assessment of capacity of criminal responsibility.
