Implementation And Influence Of The Grassland Law Of The People's Republic Of China In Gannan Autonomy State, Gansu Province

China has a large area of grasslands. The total area of the grasslands of various kinds in the entire country is 392.83 million hectares, accounting for about 41.7% of the territory, ranking the second in the world. Speeding up protection of the grasslands has great significance for ecological restoration, improvement in living standard and the strategy of sustainable development.Enforce the grassland law is a very important way to protect the grasslands. The law adopted at the 11th Meeting of the Standing Committee of the Sixth National People's Congress on June 18,1985, is formulated in accordance with the provisions of the Constitution of the People's Republic of China with a view to improving the protection, management and development of grasslands and ensuring their rational use; protecting and improving the ecological environment; modernizing animal husbandry; enhancing the prosperity of the local economies of the national autonomous areas; and meeting the needs of socialist construction and the people's life. The law served an important purpose. With the continuous development of the national socialism marketing and the technology pattern, there are a lot of new problems in practices of enforcing the law. So The Grassland Law of the People's Republic of China, amended and adopted at the 31st Meeting of the Standing Committee of the Ninth National People's Congress of the People's Republic of China on December 28,2002, is hereby promulgated after its amendments and shall go into effect as of March 1,2003.This Law is enacted with a view to protecting, developing and making rational use of grasslands, improving the ecological environment, maintaining the diversity of living things, modernizing animal husbandry and promoting the sustainable development of the economy and society. With regard to grasslands, the State applies the principles of scientific planning, all-round protection, giving priority to the development of key grasslands, and rational use, in order to promote the sustainable use of grasslands and the harmonious development of the ecology, economy and society. In line with the principle of improving the eco-environment, the protection and construction of the ecological environment will be strengthened so as to achieve sustainable development.This paper recapitulated the status of the grasslands in China, and it expatiated on the background, suitable scope, basic principles, rights and obligations, and legal responsibility of the law. This paper also researched and analyzed the ameliorations on protection, construction and utilization of the grasslands by comparing the new and old laws. Then to took Gannan Autonomy State for an example, expounded the status quo of grassland and agricultural resources in the area, and discoursed upon the implementation and influence of the Grassland Law of the People's Republic of China in Gannan Autonomy State, Gansu Province.In the end, this paper put forward some advices and conceptualizations on improving rules and regulations, tightening up the management of the grasslands, constructing the mechanism of ecological compensation, improving the way of enforcement, intensifying publicity and education and so on.
