Study On The Legal System Of Building Energy Efficiency In China

Protect and improve the ecological environment, raise the energy utilization efficiency, achieve harmony between human and nature, is becoming a rational choice after scanning the relationship between human and nature and is also the core issue of sustainable development. In energy consumption, building energy consumption occupies a considerable share. Inherent in building activities of resource consumption characteristics, the process of construction and use needs consume a large amount of natural resources, while increasing the environmental pollution, Residential building energy consumption in China has witnessed a large volume, high proportion, low energy efficiency, heavy pollution. In contrast, incomplete technical standards, imperfect law, unenthusiastic developers, indifferent people is the current situation of our country, legal system is not fully played the role of guidance and regulation. Although China's building energy legislation has gone through nearly 20 years of history, according to the practice situation over the country,laws and regulations in terms of the effect of level, the implementation of building energy efficiency standards for legal protection, or the operability of building energy efficiency laws and regulations, are still far from a complete legal system and the promotion of energy saving building healthy and sustainable development. Exploring how to establish and perfect the legal system for building energy efficiency, provide a theoretical guidance and practical reference has profound significance on the theoretical value and practice system.From the beginning of building energy efficiency and related concepts, the article stresses the necessity for building energy efficiency based on the theory described. Integrated into the method of ecological and economic value measurement, building energy efficiency is evaluated from the two aspects of ecological and economic characteristics and legal characteristics, deepening the meaning of building energy efficiency from the perspective of environmental law. At the same time, compared to Germany and the United States, which make remarkable achievements in the building energy performance and have own significantly different characteristics, by arranging and comparing the main building energy efficiency laws, we can learn from good experiences, then find out the trend of legal regulation in building energy efficiency and four specific needs in China. On the basis of the above, the existing legal system of building energy efficiency is taken into consideration. China's laws and regulations related to building energy efficiency are gradually being established, still can not meet the specific needs of building energy conservation because of the increasingly serious energy problem. Overall, throughout the current legal system for building energy efficiency in China, operational rules are not high level, the effect of law is not strong, the system of standard is not perfect, or is that, although the policy goal has been clear, in actuality, law enforcement still feels powerless. To solve the above problems, it is necessary to improve legislation and make the appropriate legal measures,establish basic building energy efficiency law system as quickly as possible, which features high level, clear law-executor, detailed provisions, rewards and punishments, conscientious administer. The desired goal is to strengthen the management of building energy efficiency and reduce building energy consumption during use, improve energy efficiency. Finally, the requirement for the design of legal system which cover the laws, regulations, rules, technical standards is multi-level, comprehensive and diverse, including the revision of the law, the support of regulations, the improvement of the building energy efficiency standards and the reference of local laws and regulations. Meanwhile, the full and effective implementation of building energy efficiency strategy, provided that we must establish a sound building energy management system, such as implementing of laws and regulations compatible with fiscal policy, improving the supervision and management system, supporting the building energy labeling system, etc.
