Study On The Government Management Function And Mode Of Water Rights Institution

Having the authority in water rights management system, government plays a significant role in the water resources management. Therefore, the role of government in water rights management becomes an important research topic. By using the theories of new institutional economics, public administration, and law, the role of the government was studied, and then the scientific and rational research basis and decision-making support for the government to improve the water rights management and optimize the utilization of water resources were resulted.In this paper, the basic theory of the water rights and the water rights management systems, government administration and government management in water right system in China, and the foreign water rights systems and government management practices were analyzed and compared. It is found that in addition to the traditional role which is the development and supervision of the implementation of laws and regulations, the water rights management system has another role which is the water resources planning and construction of the industrial structure.Based on the government functions in water rights management system transformation and the legal and market points of view of the water rights system, the Chinese government water rights management and the characteristics of the government behaviors were studied. In accordance with the degree of government intervention, the comprehensive management of water rights was balanced and integrated.The water rights and government management for renewable water and rainfall water were also studied. Renewable water rights appear the characteristics of water product rights, and the government emphasizes more on market-oriented management. However the rainwater rights are the rights of water resources which are achieved through rainwater harvesting facilities, and the government emphasizes managing rainwater harvesting facilities.A case study was carried out in Daxing District, Beijing, in terms of the water bank model program.
