The Protection Of China Miners' Rights

In this paper, the rights of China miners were analyzed, focus on the current protection of the rights of miners ,the reason of the inadequate protection of the rights of China miners, and how to promote protection of the rights of China miners.Any member of the society should have equal political status and social status. China miners should enjoy the same status and equal rights with other groups in society. But the continuous accident awake us. To protect the rights of the China miners has great significance. First of all, to protect the rights of miners is to protect the China mining industry. Bad working conditions of miners has become a resistance of the mining development. Mine accident influence not only the victims of mining but the mining industry as well. Secondly, the legislation about the China miners' rights can help improve China labor law system thirdly, to protect China miners' rights is to maintain the social stability.a stable and orderly society must respect and protect the people's right. And the protection of such rights for everyone should be equal, the inadequate protection of the rights of vulnerable groups is also a factor which easily leads to the social instability.In current China, China miners' rights lack of the protection. Their work is dangerous and always face the threats,and the bad conditions. Miners' life right can not be adequately protected, the health right is often subject to abuse, the working environment rights and other rights are not fully protected. These also allow the groups of China miners in the bottom of the society.The reasons are more complicated. First of all, thelack of traditional Chinese society lack of the spirit of law and the legal awareness, resulting in the difficulty in the protection of the rights of the miners. Secondly, from a realistic point of view, China's coal production level is not high,and not very balanced. China miners generally has low cultural quality, lack of training and basic safety awareness. In addition the relationship between miners and the mine is complex, it's difficult for the coal mining enterprises to implement relevant laws and regulations,and to make the public focus on the rights and interests of the miners,which resulted in loss of the rights of miners. Thirdly, from the scope of the law, the legislation is not perfect, meanwhile legislation is lagging behind. Security supervision is not enough, law enforcement decay basipetally. The miners lacking of judicial relief, there are still difficulties for them to get their rights. These factors are hindering the development the miners rights' protection.This paper also proposed some countermeasures to promote the protection of the rights of the China miners.First, we should try to make the China mining labor standards synchronize the international labor standards.Secondly, try to Improve the legislation. Thirdly, Strengthen the administrative protection. Fourly,Judicial relief to protect miners. The last but not the least, Strengthen social supervision.
