Study On Law Control To Prevention And Governance Of "White Pollution" In China

With the increasing of the white pollution and negative effects to our environment, several regions and sectors start to take measures on it,but the results are running below expectations.The State council "on the production and marketing restrictions on the use of plastic shopping bags of notice" is taken into effect on June 1.2008,and in which the white pollution causing by the plastic products has caught wide public concern once again.The control of white pollution isn't enforced for a long time,and the important reason is that,there are some problems on the relevant legal regulations and the practice. Therefore,it is significance of making an intensive study of legal regulation,which is effective to restrain the pollutions.This paper is aimed at the legal regulation restraining the white pollution,trying to analysis the existence of the problems using the theory of circular economy law,and exploring approach to improve the legal regulation on this basis.In the circulatory system,the author considers the production of plastic products,sales,use and recycling as the keys and assumes that there are relevant regulation laws regulate the system in the links.This article sets out to the legal regulation on the treatment of white pollution, after detailed analysis,we find that,in the process of the productions to recycling,there are more or less problems in plastic products,which are a lack of legal regulation or unmanageable problems.On the basis of the analysis various issues.Anglicizing various of issues in dope on the basis of which,the author propose that we improve the legal regulation on the white pollution in the guidelines,basic principles and so on.Guiding ideology in the legislation,it is necessary to realize that as a new type of plastic material, it is more superiority than other materials on the prevention of white pollution, launching on the improvement of system,rather than simply to restrict or prohibit the use.At the same time,it is necessary to break through the traditional of approach,the management carried in the end and extend the principle of producer responsibility to the principle that polluters should pay for it and the public participate in it,which are the relevant legal regulations.Meanwhile,the specific proposals on the production,sale, use and recycling should be improve,in order to achieve the standardize and prevent the white pollution.In the text,the innovation that we improve the legal regulation on the presentment of white pollution,by the way of combing the circular economy and industrial ecology,and on this basis,the author lodge the basic framework of legal system and specific measure to control the white pollution which is represents a useful effort for the law produced.
