Revelation To China For Emission Trading System Of America

Emission trading is a enrironmental economic policy which conforms to cost-benefit principle and has strong feasibility. The emission trading was first proposed by the American J.H.Dales in the"Pollution,Property and Prices"in 1968,and the American government later prescribed the emission trading in Clean Air Act,and then the emission trading was used in practice,and gained remarkable achievement.In the environmental management,implementing emission trading is a trend for market economy development and an important complementarity of environmental measures.In China,the history of emission trading is a little short.What we should do at present is bringing the emission trading into law,and make it rise from policy to law.Besides the introduction and the conclusion,the paper includes four parts:Part I introduces the theoretical basement of the emission trading from the economic basement and law basement.Part 2 firstly introduces backgrounds of America's emission trading and the basic policy;then expounds three trading patterns and comparatively study on overhead expenses,trading costs and cases'effects;Lastly,analyzes the practice effect and shortages of America's emission trading. The conclusion is that the advantages of the emission trading is more than the disadvantages.So the legislation on emission trading in China can refer to the America's and try to avoid its limitation.Part 3 mainly analyzes the current situation of the emission trading in China.Firstly,introduces the current law-making and practice condition of the emission trading in China;then,concludes the feasibility of putting the emission trading system in practice;finally,points out the necessity of China's emission trading at the moment.Part 4 on this foundation,summarises the revelation to China for emission trading system of America and puts forward some law-making suggestions which conforms to the situation of our country.
