On The Exploitation Of China's Oil And Gas And Its Perfection Of Environmental Protection Law

This paper has researched the exploitation of China's oil and gas. And it has also analyzed its relative laws of environmental protection. Since the setup of our country, more attentions have been paid to the development and use of this kind of resource. A lot of manpower, materials, funds, science and technology have been put into this research. After twenty years of hardworking, China has not been the country of lacking oil yet. However, with the development of China' s economy, we have more and more serious problems in the exploitation and protection of oil and gas. In 1993, our country became an oil-imported country (before 1993, China is an oil-exported country.) , which shows that the drawbacks in its relative laws are extremely serious.This paper has mainly talked about the exploitation of China's development of oil and gas. And it has also analyzed its relative laws of environmental protection. First, according to the theories of laws, this paper has thoroughly studied the exploitation of this resource and its relative laws and actual execution. And it has also explained the construction of the law system of our oil and gas. Second, on basis of actual situations, the author has talked about the environmental pollution caused from the exploitation of oil and gas. Finally, after analyzing the law systems and actual situations of this kind of resource, it has summarized all kinds of forms of the existing problems. At the same time, this paper further expounded the negative influences caused from the system defects of the exploitation of oil and gas.In order to make up for the defects, this paper has deeply analyzed the valuable experiences of foreign countries, which include the purpose, the trend and the contents of legislation.This paper, based on the analysis of domestic situations of this resource and the scientific law systems in foreign countries, has analyzed the problems and reasons in the exploitation of oil and gas and its environmental protection, so as to put forward an ideal plan. First, a standard system under the socialist market economic system should be formed. Second, we should perfect the policies and regulations in the exploitation of this resource, which include: To adjust the main policies in exploitation; to legislate Law of Oil and gas to perfect the law system of oil and gas; to perfect the relative systems in the exploitation. At last, the author talked about the perfection of legislation in environmental protection in this exploitation.Oil and gas is the most important strategic resource, which will deeply affects the economic development, social stability, national security and the smooth realization of comprehensively building a well-off society. Only by perfecting the exploitation and its relative laws in environmental protection, can we exploit the oil and gas in a scientific, efficient and sustainable way, so as to realize the sustainable development of the exploitation and environment.
