The study purpose of the dissertation is to propose a conceptual model for China’s rural collective construction land administration system through the systematic research paradigm and object-oriented design method of the geographic information science,under the constraints of the existing laws,regulations and technical specifications,and in accordance with the requirements of the Land Administration Domain Model(LADM,ISO 19152-2012).The model is used to disover the dynamic mechanism of the rural collective construction land administration system,such as the components,structures and changes.Moreover,the model consists of three components: the land tenure,land use and land value.Furthermore,the four sub-components("people"-"right"-"land" – "activity")are studied in detail in these three components.Notably,the "people" means the legal subject,the "right" means the right and obligation,the "land" means the legal object,and the "activity" means the legal fact.The proposed model should be resilient to future institutional change.The land tenure component should meet the restrictive requirements of the natural resource property right reform and the revision of the land administration law related to land tenure.The land use component should meet the restrictive requirements of the territory space planning reform related to land use control of villages.The land value component should meet the restrictive requirements of the land taxation reform to adjust the incremental income of rural collective construction land.The dissertation consists of four parts.Part 1,"identifing problems",includes chapter 1 "introduction" and chapter 2 "literature review".Chapter 1,"introduction",introduces the domestic and abroad research background,accurately identifies the research gaps,and proposes the research problems with scientific value.Furthermore,the research methodology and dissertation structure are proposed according to the research problems.Chapter 2,"literature review",tracks the research development in the fields of LADM,rural collective construction land and rural homestead land through literature retrieval and analysis,and comments on the achievements and shortcomings of the existing researches.Part 2,"identifying requirments",consists of chapter 3 "theoritical framework",chapter 4 "inistutional change",chapter 5 "legal components",and chapter 6 "technical components".Chapter3,"theoretical framework",proposes an analytical framework of the conceptual model of rural collective construction land administration system on the basis of the historical evolution of cadastre,the land management paradigm and the western land administration theoretical models.Chapter4,"institutional change",proposes a theoretical framework of "central government-local government-individual" institutional change on the basis of the theories of state governance and institutional change,and further conducts the descriptive and explanatory researches on the institutional change of the rural collective construction land on the basis of the theoretical framework.Chapter 5,"legal components",proposes a legal element theoretical framework of "concept-value-principle-rule".Furthermore,the chapter conducts a structural analysis of legal elements and extracts the legal constraints of the conceptual model in the three fields of land tenure,land use and land value on the basis of the theoretical framework.Chapter 6,"technical components",conducts a detailed analysis on the real estate registration database standard,village planning technical standard and land appraisal technical standard related to the rural collective construction land,analyzes the technical components in the three fields of land tenure,land use and land value,and extracts the technical constraints of the conceptual model.Part 3,"proposing model",consists of chapter 7 "logical structure of the conceptual model".The chapter conducts the detailded design of the core and external modules of LADM according to the requirements and constraints mentioned above.The conceptual model can be divided into the static and dynamic models.The static model describes the various sub-components of "people-right-land" in land tenure,land use and land value management.The land tenure management consists of the party package,administrative package and space unit package.Land use management includes the spatial planning package.Land value management encompasses the taxation and valuation package.Moreover,the dynamic model describes the legal processes of land tenure,land use and land value management.The dynamic model includes the legal procedure information of land tenure,land use and land value management.Land tenure management covers the administrative processes of the registration by application,registration by entrust and registration by authority.Land use management covers the administrative processes of planning permission(land use approval)for the comprehensive land use planning,urban and rural planning and territory space planning.Land value management covers the administrative processes of taxation registration,liquidation and payment.Part 4,"drawing conclusions",consists of chapter 8 "prototype testing of the conceptual model" and chapter 9 "research conclusions and policy implications".Chapter 8,"prototype testing",quickly creates a model prototype taking Java 8.x and Spring 4.x as development platform,and further tests the responsiveness of the conceptual model to legal constraints,technical constraints and system requirements.Chapter 9,"research conclusions and policy implications",compares and examines research questions and test results to draw research conclusions and reveals policy implications.The conceptual model proposed in the dissertation conforms to the international standard(LADM)and discovers the dynamic mechanism of the rural collective construction land administration system,such as the components,structures and changes.Moreover,the proposed conceptual model is a systematic empirical study on rural land administration in LADM domain,which is helpful for international researchers to better understand China’s rural land use policy.Furtermore,the proposed conceptual model conforms to the constraints of China’s legal and technical rules,and is useful to guide the establishment of China’s rural land administration system,which provides implementation tools for good rural land governance.Lastly,the dissertation effectively contributes to modeling researches of land use management,land value management,and dynamic processes in the field of LADM. |
