Research On The Theoretical Dimension Of Xi Jinping Thought On Rule Of Law

At present,with the beginning of constructing a modern socialist country,the rapid evolution of a major change globally that’s rarely seen in a century,the constantly rising instability and uncertainty of the international environment,China is steadily approaching to the center of the world stage where the tasks of domestic reform,development and stability are becoming increasingly onerous.A comprehensive promotion of law-based governance played a prominent role in the overall work of Chinese Communist Party(CCP)and the central government.The construction of law-based governance in China urgently needs a set of scientific guidelines on the rule of law,which are scientifically rigorous,systematically complete and profoundly expository.Under this historical background,in November 2020,Xi Jinping Thought on the Rule of Law was put forward initially at the Central Working Conference for Comprehensive law-based governance issues.This is another Xi Jinping Thought that CCP Central Committee has officially and explicitly brought out and comprehensively explained at a national conference,following Xi Jinping Thought on Socialist Economics with Chinese Characteristics for a new era,Xi Jinping Thought on Diplomacy,Xi Jinping Thought on Ecological Civilization,and Xi Jinping Thought on Military Strengthening.The theoretical system of Xi Jinping Thought on rule of law is extensive and profound.It runs through history and reality,integrates theory and practice,and plans for both international and domestic as a whole.It not only provides a practical guideline to the construction of rule of law in China in the new era,but also is regarded as a scientific theoretical system tested by fresh practice.From the four aspects of theoretical origin,theoretical composition,theoretical characteristics,theoretical value proposition,this paper attempts to examine,review,summarize and refine Xi Jinping Thought on the rule of law in the theoretical dimension.In the hope that it will inspire others,this paper will make a modest contribution to better explain the rich connotation of Xi Jinping Thought on the rule of law,and make this great thought better guide the practice of the rule of law in China in the new era.Xi Jinping Thought on the Rule of Law has broad theoretical origins and is the essence of wisdom and a collection of advanced ideas and scientific theories in the field of the rule of law through the ages.First,Xi Jinping Thought on the Rule of Law adheres to and applies the basic principles,viewpoints and methods of Marxist Thought on the rule of law on the general development law of human society,the dialectical materialist view of the rule of law,the historical materialist view of the rule of law,and the state and law,and inherits and develops Mao Zedong Thought on law,Deng Xiaoping Thought on the Legal System,the important thoughts of “Three Represents” and the rule of law thought in the Scientific Outlook on Development.In addition,Xi Jinping Thought on the Rule of Law observes,analyzes and solves the rule of law phenomena and difficult problems in comprehensively advancing law-based governance in contemporary China,proposes a rule of law plans and summarizes rule of law experience,and deeply reveals the remarkable advantages of the socialist rule of law with Chinese characteristics,such as maintaining social justice,protecting the legitimate rights and interests of the public and promoting the modernization of China’s capacity and system for governance.Xi Jinping Thought on the Rule of Law has many creations and breakthroughs on fundamental issues such as the value of the rule of law,the concept of the rule of law,the relationship of the rule of law and the development of the rule of law,and has formed a series of groundbreaking,contemporary and integrated theoretical achievements on the rule of law,which has enriched,innovated and developed the Marxist theory on the rule of law to a considerable extent.Second,Xi Jinping Thought on the Rule of Law focuses on exploring and expounding the resources of excellent traditional Chinese rule of law culture,constantly promoting the integration and adoption of Chinese rule of law civilization with contemporary Chinese rule of law culture,and passing on,creating,transforming and innovating the crystals of traditional Chinese rule of law wisdom that transcends time,space and national boundaries and has contemporary value in the current process of comprehensively advancing law-based governance.Finally,Xi Jinping Thought on the Rule of Law which takes a broad view of being inclusive on learning,referencing and absorbing the ideological essence of the world’s outstanding rule of law civilization,condenses the common wisdom of human beings on the rule of law,and regards it as our cultural heritage and spiritual wealth for building a law-based governance in China.Take a brief look at Xi Jinping’s political career and ideological path from 1982 when he served as the Deputy Secretary of Zhengding County Party Committee to the president of China,we could find that many of the important thoughts,judgments and strategies on the rule of law proposed by Xi Jinping since the 18 th Communist Party of China National Congress have been conceived in his local leadership practice of governing counties,cities and provinces based on the rule of law.The theoretical composition of Xi Jinping Thought on the Rule of Law is to systematically divide the theoretical connotation,main content and important aspects of Xi Jinping Thought on the Rule of Law,and form a theoretical framework with clear hierarchy,complete structure and consistent logic.Based on a series of theoretical achievements on the rule of law continuously explored,refined and summarized by Xi Jinping during his long-term leadership of the rule of law practice,which are the core research content,and in accordance to the different functions and functions,this paper presents the theoretical composition of Xi Jinping Thought on the Rule of Law into five parts: the road direction theory of comprehensively promoting the rule of law,the work layout theory of comprehensively promoting the rule of law,the theory of a main project of a rule of law,the theory of talent supply plan for the rule of law and the theory of governing the Party according to rules.Among them,the theory of the road direction of rule of law includes the theory of overall CCP’s leadership theory in law-based governance,the people-centered theory,and the theory and in matters involving foreign parties;the theory of the major project of rule of law includes the theory of governing the country according to the Constitution,and the theory of comprehensively promoting scientific legislation,strict law enforcement,impartial administration of justice,and law abiding by all;the theory of talent supply plan for the rule of law includes the theory of developing a high-caliber body of skilled and upright legal professionals,and the theory of ensuring that leading officials at every level,though few,play a key role in implementing the rule of law;the theory of inner-Party laws and regulations includes incorporating inner-Party laws and regulations into the socialist rule of law system with Chinese characteristics,clarifying the organic and unified relationship between governing the country by law and governing the Party according to rules,and putting forward the idea of building the Party and running the Party according to rules in the same direction.Based on systematically sorting out the major propositions,concepts and views started by Xi Jinping Thought on the Rule of law and in the practice led by the rule of law,and with the support of detailed historical data,the paper further summarizes and refines the six distinctive theoretical charasteristics of Xi Jinping Thought on the Rule of Law ‘the political position of people supremacy’,‘Consistent thinking of rule of law’,‘the systematic thinking of integrating all parties’,‘the broad and inclusive overall perspective’,‘the practical orientation of realism and pragmatism’ and ‘dialectical unified analysis approach’.Xi Jinping Thought on the Rule of Law fully reflects people-centered values.The initiation of all concepts of rule of law,implementing all legal systems and the development of all law practice,keeps close to the points of attaching people,depending on people,and benefiting people,which embodies the political proposition of putting people first;the concept of rule of law is the thinking method for Xi Jinping’s governance of the country and the implication of the rule of law;the reinforcement of the development of the concepts of rule of law,the practice of further law reform by accomplished use of the concept of law,promoting the development law-based governance,resolving the conflicts in law-based governance,protecting social harmony,and facilitating social stability,are important supporting points of constructing law-based governance in China.From the strategic perspective of opening up a new path of socialist rule of law with Chinese characteristics and building a strong modern socialist country under the rule of law,Xi creatively proposed the ‘Two Centenary’ goals,the‘Five-sphere Integrated Plan’,and the ‘Four-pronged Comprehensive Strategies’,demonstrating the systematic thinking and overall perspective of coordinating all parties;the application of Marxist dialectics on comparing and analyzing and giving scientific interpretation and incisive exposition,shows the dialectically unified scientific analyzing method when dealing with the relationship between reform and law-based governance,the relationship between the party and law,the relationship between development and safety and a series of major conflicting relationships.The theoretical value proposition of Xi Jinping Thought on the Rule of Law is Xi Jinping’s specific preference and pursuit of certain things,states and situations in the field of the rule of law,and it is the internal driving force that promotes the continuous innovation,evolution and development of Xi Jinping Thought on the Rule of Law.The generation and development of the theoretical value of Xi Jinping Thought on the Rule of Law are profoundly influenced by socialist core values.Xi Jinping Thought on the Rule of Law is based on socialist core values,and is in the form of the fundamental value orientation which fully demonstrates the socialist core values.Among them,there are five core values that are most closely connected with the rule of law behind the great theoretical system of Xi Jinping Thought on the Rule of Law,which are ‘defending civil rights through rule of law’,‘Promoting Social Equity and Justice through rule of law’,‘guaranteeing economic development through rule of law’,‘ensuring national security through rule of law’,and‘maintaining social harmony and stability through rule of law’.Xi Jinping Thought on the Rule of Law has always taken effective protection of people’s legitimate rights and interests as the fundamental criterion for legislation,law enforcement and the supervision of law,this reflects the value pursuit of Xi Jinping Thought on the Rule of Law to defend civil rights by the rule of law;he thinks highly of implementing the new development concept through the rule of law,and the establishment of a legal order to maintain fair competition.He believes market economy must be the law-based economy where the rule of law provides the best business environment.This reflects its value persuits on using legal instrument to promote and protect economic development.Xi Jinping Thought on the Rule of Law upholds the overall concept of national security and regards national security as an important task in the CCP’s governance of the country and in advancing the rule of law.He stressed that a comprehensive legal system for national security should be put in place to ensure China’s long-term peace and stability,social stability and order,and the people live and work in peace and contentment.It attaches great importance to the role of the rule of law in guiding and guaranteeing social harmony and stability,and emphasizes that,in essence,a harmonious society must be ruled by law.Social harmony is the essential feature of a socialist country with Chinese characteristics.A clear grasp of the theoretical value orientation of Xi Jinping Thought on the Rule of Law provides an important theoretical reserve and support for us to deeply explore the nature,attributes and functions of Xi Jinping Thought on the Rule of Law theory,and to investigate the internal ideological motivation that governs the continuous innovation,evolution and development of Xi Jinping Thought on the Rule of Law.
