The "Resolution of the Central Committee of the Communist Party of China on Major Issues Concerning Comprehensively Advancing the Rule of Law" makes major arrangements for deepening the rule of law with strict discipline,and clearly calls for improving the rule of law in national defense and the armed forces.On March 7,2022,when attending the plenary meeting of the delegations of the PLA and the PAPF,Xi Jinping once again stressed the need to implement the strategy of governing the military in accordance with the law and improve the rule of law in building national defense and the armed forces.Education in Chinese military colleges and universities is an important part of construction of national defense and armed forces.Accelerating the rule of law process of education in Chinese military colleges and universities will play an indispensable role in comprehensively improving the level of national defense and military rule,and will also provide reliable support for the realization of the rule of law in national defense and military construction at an early date.At present time,with the deepening of the rule of law process of the national defense and military construction,a number of problems faced by the rule of law process of education in Chinese military colleges and universities are becoming increasingly prominent.For example,how to learn and improve the theories of the rule of law in military education,how to standardize the administrative powers in military education effectively,how to properly deal with the legal relations among educational subjects,how to effectively protect the legitimate rights and interests of education subjects.These issues are crucial topics which need to be paid attention to in the construction of the rule of law process of education in Chinese military colleges and universities.The dissertation mainly studies the basic theory in the rule of law process of military education,examines the history of the rule of law,reviews and draws inspirations from the American and Russian rule of law process of military education,analyzes the current situations of the rule of law and puts forward the more targeted and specific measures.Specifically,the dissertation consists of following six major parts:Chapter Ⅰ “Introduction” offers an overview of the research background,methods,and innovation,in order to lay the foundation for the subsequent chapters.Chapter Ⅱ “Basic Theory on the Rule of Law Process of Education in Military Colleges and Universities” defines the relevant concepts,presents an introduction of the Guiding Theories of the Party and the Advanced Theories on the Rule of Law.The Guiding Theories of the Party summarizes and expounds the advanced thoughts and theories of the successive leaders of the Party on the governance of the Party,the Army and education,with a special focus on the Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era and its far-reaching impacts.The Advanced Theories on the Rule of Law entail topics,such as the Essence of Education,the Equity in Higher Education,Governance of Public Power,Axiological Integration of Safeguarding Soldiers’ Interests and Seeking Military Order,Law-based Protection and Guarantee of Right to Education,Combination of Centralized Leadership and Open Operation of Schools,the theory of Advancing Law-Based Governance and so on.Chapter Ⅲ “Historical Development of the Rule of Law Process of Education in Military Colleges and Universities” periodicalizes the history into four stages: the Revolutionary War Period(1927-1949),the Exploration and development Period after the founding of new China(1949-1978),the Innovation and Development period after the Reform and Opening Up(1978-2012)and the All-Round Development Period in New Era(2012-).It summarizes the characteristics of each historical period,and aims to provide reference for the formulation and improvement of countermeasures.Chapter Ⅳ “Investigation into the Rule of Law Process of Education in American and Russian Military Schools and Lessons to Be Learned”conducts comparative research with two western military powers,namely the United States and Russia so as to draw lessons or points of references to improve China’s rule of law process of education in military colleges and universities.Chapter Ⅴ “Investigation of the Current Situations of the Rule of Law Process of Education in Chinese Military Colleges and Universities”analyzes the status quo of the rule of law process of education and identifies both positive and negative aspects.First,it summarizes the achievements in the rule of law process of education in Chinese military colleges and universities,including the further enhancement of public awareness of the law,the further standardization of legal norm system,the further standardization and institutionalization of civil-military talent training system.Secondly,it points out the main problems and briefly discusses its causes,including the disfunction of legal methodology as well as the lack of reasonable legal system and satisfactory enforcement in colleges and universities and so on.Chapter Ⅵ “Basic Countermeasures to Promote the Rule of Law Process of Education in Military Colleges and Universities” puts forward four measures,including the consolidation of the guiding role of Xi Jinping’s Legal Thoughts,the formulation of scientifically-grounded educational goals,the enhancement of legal system and the standardization of educational governance in military colleges and universities.
