The Evaluation Research On Construction Of Law-based Society

Since the 18 th CPC National Congress,"Building a country,a government and a society under the rule of law" has become one of the important goals and tasks of comprehensively governing the country by law in the new era.A country,a government and a society under the rule of law have their own priorities and complement each other.It constitutes the three pillars of the rule of law in China.As the rule of law is further advanced,"the construction of law-based society" is endowed with the specific connotation and value goal of "the foundation project of the construction of law-based country".All sectors of society are increasingly aware that only by strengthening the construction of a society under the rule of law,continuously promoting law-abiding by the whole people,and improving the level of legalization of social governance,can we ensure the ultimate realization of the goal of a country under the rule of law and effectively promote the modernization of the national governance system and governance capabilities.In order to further promote the construction of a society under the rule of law,the central government issued the "Implementation Outline for the Construction of a Society under the Rule of Law(2020-2025)",which laid out the overall goals,work layout,and key tasks of the construction of a society under the rule of law during the "14th Five-Year Plan" period.This marks that the construction of a society under the rule of law has entered a new historical period of institutionalized,normalized,and targeted development.Therefore,systematic and comprehensive research on the evaluation of the construction of law-based society is undoubtedly of great theoretical innovation and practical guiding significance.First of all,this article conducts a comprehensive and in-depth analysis of the connotation,constituent elements and characteristics of law-based society.Based on a comprehensive review of the main methods and experiences of the rule of law evaluation at home and abroad,four principles and five methods for the law-based society evaluation are proposed.From the three levels of evaluation subject,object and content,the constituent elements of the law-based society evaluation system are explained separately.Based on this,a relatively complete indicator system for the law-based society evaluation is proposed.This article is divided into four parts: The first chapter expounds the connotation and elements of law-based society,combined with the specific history and real context of the modernization of the rule of law in China,and analyzes the characteristics of law-based society from the perspective of comparison between the China and the west.The second chapter describes the main methods and experiences of domestic and foreign rule of law evaluation,and compares the characteristics and advantages of existing methods such as "official evaluation" and "third-party evaluation".It specifically analyzes the similarities and differences between the "rule of law evaluation" in the overall sense,the "law-based government evaluation" and the "law-based society evaluation" in the specific sense.The third chapter puts forward the principles and methods for law-based society evaluation,and conducts demonstrations around the purpose,methods,ought and actuality of law-based society evaluation.The article proposes that law-based society evaluation should follow the principles of democratic participation,scientific rationality,legal evaluation,and operability.The article lists five methods to analyze the law-based society evaluation,including the qualitative and quantitative theoretical,the subjective and objective indicator setting,big data,Delphi method,and meta-evaluation.The fourth chapter takes the evaluation subject,evaluation object,and evaluation content as the logical main line,and proposes a relatively complete indicator system for law-based society evaluation.Among them,the subject corresponds to the credibility of the evaluation,the object determines the object and structure of the evaluation,and the content affects the scientificity and feasibility of the evaluation.The evaluation index system proposed in this article takes the process of building a law-based society as a full perspective,covering five dimensions,including protection of civil rights,social institutionalization,legalization of social governance,legalization of network management,and law-abiding by the whole society.The evaluation system takes into account both subjectivity and objectivity,which specifically consists of 5 first-level indicators,18 second-level indicators,and 50third-level indicators.
