3D printing,which has been hailed as adisruptive technology sparking the fourth industrial revolution,is transforming China’s traditional one-way production and manufacturing mode into a decentralized one characterized by personalization,socialization and networking.This technology further blurs the boundaries among designers,producers,sellers and consumers,and greatly reduces the production costs of various products.With the popularization of 3D printers,the increase in the types of 3D pringting materials,and the increasing accessibility of 3D printing CAD models,3D printing production mode has gradually been penetrating into all aspects of people’s life.What is particularly noteworthy is the increase in the number of 3D printed guns,controlled cutting tools,food,drugs,medical devices,human organs etc.These 3D printed products can bring about a series of security concerns that should not be underestimated.In particular,they can not only pose huge threatens to the national public security,but also strongly affect the economic and social development.Moreover,they can also have an ill effect on the personal and property safety of citizens.In order to increase the effective supply of 3D printing security regulation,it is necessary to find the optimal regulation path through cost-benefit analysis under the multiple choices among administrative regulation,judicial regulation and self-regulation.This paper intends to study the security of 3D printing from the perspective of social regulation.By establishing the cost-benefit analysing framework of social regulation,it compares and analyzes the regulatory efficiency of administrative regulation,judicial regulation and self-regulation in the field of 3D printing security,and constructs a diversified cooperative regulation mode,which is aimed to achieve a better regulation effect at a lower cost.First of all,by using empirical research methods,this paper analyzes the current situation of 3D printing security regulation in China.Through the comparative analysis of regulatory motivations of government,3D printing manufacturers and producers,3D printing users and othersubjects,this paper demonstrates the importance of balancing the cost and benefit of 3D printing security regulation for a surely effective supply of 3D printing security regulation.Secondly,based on the three paths presented by administrative regulation,judicial regulation and self-regulation,by combining the characteristics of 3D printing personalization,socialization and networking,this paper analyzes the optimization and balance of cost-benefit of 3D printing security regulation.At the same time,through acomparative case study,it conducts a comparative analysis of foreign regulatory measures for 3D printing security and presents useful reference.Finally,by taking the implementation cost as the standard,this paper compares and analyzes the advantages and disadvantages of administrative regulation,judicial regulation and self-regulation,and constructs a diversified cooperative regulation mode which can be appliedin China.In view of the insufficient supply of 3D printing security regulation,this paper suggests the application of the cooperative regulation path where administrative regulation,judicial regulation and self-regulation work in parallel,and no boundaries set between administrative power,judicial power and social power.It believes that we should abandon the traditional single,hierarchical regulatory structure,and pay attention to the interdependent regulation.With cost-benefit as the control parameter,different regulatory subsystems should be combined to form an orderly regulatory space to achieve better regulation effect with lower cost.While setting the subject and participants of the cooperative regulation and defining the legal relationships thus occurred,the administrative law should allocate regulatory rights based on resources and create a set of specific action structure,including subject system,responsibility system and technical system,in order to enhance the legality,legitimacy and predictability of regulatory behavior.In modern society,new technologies such as 3D printing,artificial intelligence,big data,cloud computing and other new technologies are constantly emerging,which brings new things such as new industries,new formats and new models with great uncertainty,and human beings are always faced with uncertain security risks.These changes have blurred the differences between government and market,public and private,and made the non instrumental side of social regulation more noticeable than before.The government is not necessarily the core of regulatory governance,and the law can rely on its own norms for self creation.Based on the administrative process,the "new administrative law" is constantly transcending the relief-centered mode,and pays attention not only to the protection of private rights,but also to the administrative efficiency and interest coordination.Therefore,in the context of reshaping the social regulation,the case study of3 D printing security regulation is of great significance.
