Research On Cost-Benefit Analysis In The Regulation Of United States

While administrative law requires the government to administer legally,it also requires the government to administer rationally.While strictly preventing the government from arbitrarily exercising power,it also respects and allows it to exercise power scientifically and rationally through legal channels.In order to realize the above-mentioned ideal picture,the legal system needs to make advance judgments on the exercise of government power in advance,and judge whether it is reasonable and legal.In the practice and research of administrative law in the United States,the costbenefit analysis of the exercise of administrative power has become an important topic.U.S.law clearly stipulates that eligible administrative regulations must undergo cost-benefit analysis.The main method is to use the knowledge system of economics to evaluate government actions in different time periods by extracting,analyzing,and comparing the social costs and social benefits of formulating policies.The actual effect.After that,the net social benefits of government actions can be obtained based on the difference between social benefits and social costs,so as to hope to maximize the overall welfare of the society.The methods involved in the system have important reference significance for how to judge the effect of government power exercise.In order to further understand the system and grasp the advantages and disadvantages of the system more comprehensively,this article discusses the topic selection ideas in the introduction of the first part,and summarizes the relevant domestic research.In the second part,it briefly introduces the concept,origin,status quo and function of the system.In the third part that follows,according to the above concepts and principles,this article analyzes the cost-benefit analysis of a typical administrative regulation according to its type of analysis mechanism.In the fourth part,in response to the above-mentioned concept and analysis mechanism,this article briefly combs the analysis report of the U.S.Environmental Protection Agency on air governance regulations.In the fifth part,this article discusses different types of costbenefit analysis in practice,including cost-benefit analysis conducted at different points in time and considering other normative values.In the sixth part,this article puts forward the reference value of this system to our country’s administrative rule of law based on the above discussion.
