The Communist Party of China is a Marxist ruling party that holds political power and has been in power for a long time.The way of leadership and governance of the Party is closely related to the governing ability and level of the Party.Therefore,based on scientifically summarizing historical experience and drawing on the outstanding achievements of global political civilization,the Party has established law-based governance as the basic way for the Party to govern the country.Stepped into a new era,aimed to lead the people to implement the Chinese Dream of great rejuvenation,building socialist modernization power,the Party must follow the concept of modern governance,insist and improve the basic way of ruling the governing according to law,implement the Party’s overall leadership of the state power,insist science ruling and democratic ruling at the same time,and improve the level of the party’s ruling ability and leadership constantly.This paper is divided into four parts:The first chapter mainly discusses the related theoretical issues of ruling by law and expounds the basic connotation of exercising state power based on law.On the other words,according to the Marxist classical writers’ basic idea and practice about the proletarian party,compare with the main western developed countries’ ruling party,the socialist countries’ ruling party such as Soviet Communist Party and the Chinese Nationalist Party’s(KMT)ruling way,summed up the Chinese Communist Party’s special provisions of law-based governance and the advantages of governance.The second chapter mainly sorts out the historical exploration of ruling by law during the period of partial ruling by the Communist Party of China,after the seizure of political power and the comprehensive ruling by the Communist Party of China until the 18 th National Congress of the CPC.This paper argues that create revolutionary base area in land revolution period,the party leads the people to establish series of red regime,which means the party’s leadership over the state power is already preliminary exploration,at the same time,the party also pay attention to the normative documents by written or unwritten exploration of law-based governance in the new era and the current existing practical problems.To govern the country,we must first govern the party,and we must govern the party strictly.Since the18 th National Congress of the CPC,the Party has strengthened its leadership and Party building by comprehensively governing the Party with strict discipline,and its position as the core of leadership and achievements and existing problems in the new era should be viewed in an objective and fair way,and the good experience should be upheld while shortcomings should be improved.The fourth chapter mainly discusses the path of optimizing the CPC’s law-based governance.To govern according to law in the new era,the Communist Party of China must lead the people in exercising their franchise,administrative authority and supervision right in accordance with the law.The Party leads the people in exercising their franchise in accordance with the law,must strengthen the ranks of cadres and personnel for governance,focusing on training highly qualified and professional cadres and gathering outstanding personnel from all walks of life who are patriotic and dedicated,so as to strengthen the ranks of mechanisms.From the point of view of rule by constitution,and strengthen the implementation of the constitution supervision and safeguard the constitution authority,insist on governing the country according to law,ruling according to law,promote administration according to law,adhere to the country under the rule of law and the rule of law government,rule of law society construction,strengthen the inner-party laws and regulations and the execution of the laws of the state,give full play to the rule of law in promoting the modernization of national management system and management ability of main responsibility for implementation,seize the key minority.Second,we must strengthen the party construction of supervision system of centralized and unified leadership,dominated by the inner-party supervision,to promote a complete coverage of supervision,deepening the reform of discipline inspection system to perfect the system of the party and state supervision;Finally,we should focus on key areas to carry out supervision,innovate supervision methods,promote the integration of anti-corruption,deepen the case to promote reform,cases to promote governance to promote the precision of supervision.
