In November 2018,the “gene-edited babies” were born,which marked the beginning of germline gene editing technology from the laboratory to the public.As soon as the news came out,it quickly stirred up an uproar and aroused widespread concern and strong condemnation.This event has made the issue of risk prevention in the utilization of cutting-edge gene editing technology come into the field of views once again.At the time when human beings are constantly pursuing technological progress,gene editing technology has made precise modification of human genes a reality.It not merely plays a significant role in basic research such as gene screening and cell model construction,but provides new ideas for gene therapy of a good many diseases as well.However,when the promise of human health is intertwined with the potential for a series of failed clinical trials,technical misses and ethical loss,gene editing has brought unprecedented risks and threats to human evolution and population safety in its development process.The possibility and uncontrollability of “reforming humanity”are enough to make the society worry.At a time when technological benefits are so closely linked to risks,our country must guard against the risks of human gene-editing technology utilization and incorporate such technology into the scope of risk prevention on the basis of science,so as to effectively reduce and eliminate the possible adverse effects on human beings brought by gene editing technology utilization.Accordingly,this dissertation firstly defined and elaborated the relevant basic theories of human gene editing technology.Taking human gene editing technology acceptance willingness as the research premise,a model of the influence factors of technology acceptance willingness was constructed based on questionnaire survey and data analysis,which focused on public perception on the acceptance of human gene editing technology in China.And the risk factors such as privacy risk,ethical risk,physical risk,time risk,economic risk,social risk were examined eventually.Despite the risks,there was still public demand for human gene editing technology,so the study of acceptance willingness became the basis for research into the development,utilization and risk prevention of this technology.Secondly,the grounded theory was used to construct the regulation model of human gene editing technology utilization risk prevention based on the expert opinions.Taking expert opinions as one of the basis to guide the public and the utilization of human gene editing technology to improve regulations.The model showed that laws and regulations on the development and application of human gene editing technology as well as its concept definition,legal norm,legal liability,supervision intensity,rights and interests protection have a significant impact on the practical effect of on risk prevention of human gene editing technology utilization.Using evolutionary game theory to further explore the reasons for inadequate supervision of human gene editing technology utilization in China,it was found that the healthy development of gene editing technology market depended on the supervision intensity of government regulators,the punishment intensity of nonresponsible gene editing parties,and the reward intensity of successful supervision by regulators.This was the second basis for regulating the utilization of human gene editing technology.Thirdly,the existing problems of laws and regulations were explored through an analysis of relevant laws and policies in this field in China,which not only confirmed the research findings of grounded theory,but also became the third basis for improving regulations.Then,comparatively analyzing the legal regulation practice on utilization risk of gene editing technology in some foreign countries and trying to learn from it,which was the fourth basis for perfecting regulations.In the end,from the dimension of evading the risks caused by human gene editing technology utilization and its own characteristics,proposing specific prevention strategies for the various risks identified by the public in accepting the technology,so as to provide a design scheme for reference for the benign development of gene editing technology utilization,as well as provide decision-making reference and empirical basis for central and local governments to formulate effective regulatory policies. |
