Private regulation generally refers to a series of rules and practices created by various private entities.The emergence of private regulation is the adaptation to the complexity of the global problem and the complement of the traditional governance system.This paper defines private regulation as a governance regime which is based on the standards of labor,human rights and the environment,these standards are created by multinational companies,nongovernmental organizations and civil society.The rules and standards are the most important aspects of this kind of governance regime.This kind of governance regime mainly acts in social and environmental fields,it is an important way to alleviate the "governance deficit" and also an important path for private authority to play its role in global governance.Some scholars put forward that its "ratchet effect" in global governance makes it the most innovative system design in the past 50 years.Therefore,the core question of this article is how does private regulation play a role in global governance,that is to say,what is its behavior logic? This problem not only involves the acting mechanism of private regulation,but also the behavior strategy of it.Behavior logic is an important tool to study the specific mode of a governance mechanism.In order to analyze the governance mechanism and effect of private regulation,this paper puts forward a research framework of behavior logic of private regulation.This paper holds that due to the comprehensiveness of its governance objectives and the uniqueness of its own nature,private regulation has formed highly complex behavioral logic in the process of governance practice,which includes the following three types: control logic,empowerment logic and market logic.Generally speaking,private regulations manage and regulate the productive and managerial behaviors of relevant actors through control logic,so as to realize the environmental value of governance.The empowerment logic aims to achieve the social goal of the governance mechanism by empowering stakeholders.Market logic takes the market supply and demand as the profit lever,guides and restricts the operation behavior of market actors,so as to realize the economic value of governance.It is this kind of complex logic that makes private regulation has unique advantages in dealing with global issues.It can give consideration to environmental,social and economic values and achieve more efficient and all-round governance effects.The introduction part of this paper describes the research background,research methods and the significance of private regulation.The beginning of the paper is the introduction of the phenomenon of the "failure" of global governance,and then discusses the achievements of private regulation.Thereafter,the author constructs the theoretical framework of the paper,and analyzes and discusses the essential driving force,theoretical basis and specific forms of the logic of private regulation behavior.In order to verify the proposed analytical framework,the paper selects the International Forest Stewardship Council as a case.It is found that FSC realizes the governance value of environment,society and economy by virtue of the three behavioral logics of "control","empowerment" and "market".First of all,FSC constrains the production and operation behavior of relevant actors by formulating standards and rules on forest management and production of forest products and establishing implementation guarantee mechanism to realize the environmental value of governance.Secondly,FSC empowers stakeholders through system design,knowledge production and dissemination,thus realizing the social value of governance.Among them,the system design mainly includes "three seats" mode,public consultation mechanism,dispute resolution system,open platform and so on.The production and dissemination of knowledge mainly includes three levels: value idea,concept innovation and practical information.Finally,FSC uses market logic to realize the economic value of governance through two ways: market incentive and market publicity.Among them,market incentive measures include trademark provision,market movement and so on.The marketing propaganda mainly includes the construction of the propaganda network,the expansion of the main body of communication,the mass media propaganda and the use of rhetorical strategies.The conclusion of this paper discusses the international forest issues and the current development of the FSC,and points out the research shortcomings of this paper and the potential directions and key areas of private regulation research. |
