Intellectual Property Rights And China Firms' Export Innovation

With the reduction of trade costs and the acceleration of economic globalization,the form of international trade has changed greatly."Knowledge" as an independent factor participates in the process of international division.International competition is becoming more and more intense.In the current stage of international trade,it is no longer a commodity trade between countries,but a direct competition between firms for international market share.Because of the impact of intellectual property system on international trade,patent ownership has become an important support for enterprises to participate in the international market.The product map of enterprises is no longer decided by transportation cost,but is determined by the patent map.Intellectual property has a profound influence on international trade.On the one hand,the intellectual property system provides protection for the existing technology and products.This protection of innovators will further widen the gap between technology leaders and follower.On the other hand,the intellectual property system has raised the threshold for firms to participate in the international market,and put forward higher requirements for the innovation ability.China's economy is strongly dependent on the international market.Under the background of great changes in the form of international trade,can China's economy adapt to the new international trade environment and achieve development while opening to the outside world.In this context,this paper studies the impact of intellectual property rights on the export innovation activities of Chinese firms.The second chapter reviews the literature of the relationship between trade and innovation,including inter-industry trade,and intra-industry trade.At the same time,the relationship of intellectual property and innovation,intellectual property and trade are introduced.China's export firms are facing domestic and foreign markets at the same time.The foreign intellectual property system has a strong discriminatory color,which is manifested as a "trade barrier".Because of such differences,the third chapter,based on the 337 investigation in the US,investigates the influence of intellectual property barriers on export innovation activities of China firms.It is found that the 337 survey has a positive impact on the export innovation,and there is a difference in the type of technology.The effect on high-tech enterprises is more obvious,and of the low-tech enterprises is not significant.The fourth chapter studies the relationship between the protection of local intellectual property rights and the export innovation from the angle of intellectual property execute.It is found that there is a significant export innovation effect in Chinese enterprises,but the significant level of this effect is positively related to the strength of local intellectual property protection.In regions where intellectual property execute is stronger,the export innovation effect is very significant,while in the weaker enforcement region,the export innovation effect is not statistically significant.In order to test whether export innovation effect is dependent on the environment of intellectual property system,this paper tests the threshold of intellectual property protection in export innovation activities by a panel threshold effect model,and finds significant single threshold effect.In the coefficient estimation,the export innovation effect of the regions with strong intellectual property rights is 0.7-1.2 percentage points higher than that of the weaker law enforcement regions.The results show that the stronger the protection of local intellectual property rights,the more conducive to the export enterprises to form a scale economy,and then reduce the marginal cost of production.With the implementation of the "rule of law" strategy in China,intellectual property litigation has gradually played a leading role in the system of intellectual property rights.The fifth chapter of this paper analyzes the relationship between intellectual property litigation and the effect of firms export innovation.It is found that the participation of intellectual property litigation has a significant positive impact on the export innovation,whether as a plaintiff or a defendant,the estimated coefficients are positive and statistically significant.This shows that participation in intellectual property litigation can improve the understanding of intellectual property rights,and then improve the expected returns of export innovation.At the same time,it is found that winning action has a significant positive impact,while losing the lawsuit has no effect on export innovation.The amount of compensation is positively related to the export innovation effect,and the amount of compensation is negatively related.In addition,from the form of wins and loses,we found,direct judgment decision like dismiss and stop infringement have a significant positive impact,but with the withdrawal as the main form of judgment,the impact is not significant.The results of this study have clear policy implications for China's trade policy and intellectual property policy.In terms of trade policy,deepening the level of opens is a way for China to continue to approach the frontier of international technology.With the transformation of international trade situation,China's trade competition policy should focus on supporting high tech firms with high productivity.In terms of intellectual property system,properly enhancing the level of intellectual property protection,improving the efficiency of intellectual property litigation and rise the amount of compensation will be beneficial to China's export innovation and economic growth.
