| The administrative power list system is a product of the combination of constitutional theory and China’s national conditions.It is based on the dual practical needs of power supervision and management services,and has the practical functions of clarifying the content of power,framing the boundary of power and improving the efficiency of administrative services.The lack of legal definition of administrative power list leads to the dilemma of practical and theoretical research.Although many scholars have sorted out the concept of administrative power list from different perspectives,it is difficult to accurately grasp the concept through these one-way theoretical analysis.This paper analyzes its constituent elements in an all-round way by deconstructing,systematically,scientifically and accurately excavating and discussing its connotation from the four aspects of the subject,scope,procedure and basic functions of the administrative power list,and differentiating it from the responsibility list and the negative list.The definition of the attributes of the list of administrative powers has always been the focus of controversy in the academic circle.Based on the definition of the concept of administrative normative documents in the relevant notice of the state council in 2018,this paper believes that the list of administrative powers fully conforms to the characteristics of administrative normative documents and its attributes should be defined as administrative normative documents.The practice of the rule of law has given birth to and developed the administrative power list system,and at the same time,it is calling for its creators and practitioners to dig deep into its theoretical basis and explore the institutional evolution path suitable for its development and improvement.This paper teased out the administrative power listing the changes of the system development process and system value,with empirical research methods,analysis of existing problems and the causes of the current system,and puts forward to perfect the countermeasures and measures,the key path is a list of administrative power system under the rule of law,from the legal level to promote and safeguard,and the base number of locking system. |
