Enforcement Of Intellectual Property Rights In Myanmar

The thesis examines the legal and institutional frameworks for enforcement of intellectual property rights in Myanmar.Enforcement of intellectual property rights involves two factors.The first is formulation and enactment of intellectual property law.The second factor is the implementation of legal provisions.It includes interpretation of law and determination of cases by the courts,investigation of intellectual property rights violations,prevention of unauthorized use of the intellectual property rights and the use of sanctions and remedies provided by law.The thesis also examines the current legal framework of intellectual property rights and their enforcement and new intellectual property laws system(trademark law,draft copyrights law,and industrial design law)in Myanmar.The main objective of this thesis is to explore the current status of enforcement of intellectual property rights in Myanmar and identify deficiency frameworks in the current legal and institutional framework for enforcement of intellectual property rights.With respect to the current status of intellectual property law system,the thesis finds that Myanmar need development of IP legal system,implementation of effective and transparent IP laws,strengthening of enforcement,increasing experts of IP practice,development of IP related laws.The thesis concludes by findings discussion and recommendations on the necessity frameworks for efficient and effective enforcement of intellectual property rights in Myanmar.
