| ’The content of Free Trade Agreement between the People’s Republic of China and the Swiss Confederation is very comprehensive, which includes trade in goods, rules of origin and implement procedures, trade remedies, technical barriers to trade, sanitary and phytosanitary measures, trade in services, investment promotion, competition, protection of intellectual property rights, environmental issues, economic and technical cooperation, institutional provisions, dispute settlement and so on. It is the first free trade agreement between China and the European continent and one of the world’s top 20 economies, in which China first stipulate the specific provisions of intellectual property enforcement. It’s also one of the highest levels of trade agreements that China has reached in recent years. Today, all countries in the world are increasingly focusing on intellectual property enforcement, which as an important part of trade agreement will have a profound impact on China’s future negotiations with other countries and regions to sign a free trade agreement.This paper includes an introduction, a body text and a conclusion. The body text includes the following four parts:The first part is about the concluded background and basic contents of China-Switzerland FTA. Its contents include:First, it introduces and analyses the the concluded background of China-Switzerland FTA through the international trade shifting from the multilateral negotiations to bilateral negotiations, and the industrial structure and trade conditions of China and Switzerland; Secondly, it evaluates and analyses the basic content of China-Switzerland FTA, which includes "Trade in Goods", "Trade in Services", "Investment Issues" and "other contents".The second part analyses the terms of intellectual property enforcement and the relationship with other provisions in China-Switzerland FTA. It analyses the content of intellectual property rights enforcement of the Agreement from the following three aspects:First, it defines "intellectual property rights" and "intellectual property enforcement". Secondly, it summarizes the principles and general rules of intellectual property enforcement in the agreement. Finally, it discusses the specific rules of intellectual property. enforcement in the agreement and the provisions of intellectual property enforcement in Switzerland and China. On the relationships between the terms of intellectual property enforcement and other provisions, it mainly analyses the relationships and differences between the terms of intellectual property enforcement and the basic principles, the trade regimes, the dispute settlement mechanism, and investment issues of the agreement.The third part compares the terms of intellectual property enforcement in China-Switzerland FTA with related agreements. This part selectes the corresponding content of the TRIPS Agreement, China-Chile FTA and China-New Zealand FTA to compare.The fourth part analyses and summarizes the enlightenment of the terms of IP enforcement in China-Switzerland FTA to China signing FTA in the future. Based on the argument and analysis of above parts, this part sums up the enlightenment of the terms of intellectual property enforcement in the agreement on China and the developed countries or developing countries signing the FTA in the future. |
