During first half of the 20 th century, China had undergone a vavious change,and the change is complete and thorough, profound and complex. At the same time, this change is always accompanied with the change of legal thought. The transformation of the law idea effectively laid the foundation of Chinese legal system's modernization.From the point of view of the subject, any first-level discipline will be incomplete, superficial and lack of depth without its special historical supports. Law is no exception. The place of legal history is just here.After the development of the 20 th century, The discipline of Chinese legal thought has almost arrived general and deep research. But this phenomenon is not the end of the development of the discipline. Discipline and academic development have no end. We will always face new problems. At the same time, The research about history of legal thought itself is also meeting various problems. Academic history research will open a new door for the discipline of Chinese legal thought.This article includes five following parts: introduction, six chapters and conclusion.The introduction is mainly about the reason of my choice, academic, research methods, research framework, etc. This will help us have a overall understanding for this article.The first chapter mainly introduces the background of society before the discipline of Chinese legal thought history formation. The rise of Chinese legal thought history as a formal subject must have the social, cultural background, etc. This chapter will analyze respectively from the social background, cultural background, and subject situation in three aspects, their impact on the subject of Chinese legal thought history.The second chapter mainly introduces the overall development situation after the rise of disciplines, such as the discipline characteristic, representative, etc. We will have a macro grasp about the development of discipline in this period through the introduction about this part. In the late 19 th century early 20 th century, under the dual effects of “the New Deal in the late Qing dynasty” and “the Eastward Transmission of Western Science”, the traditional academic system is gradually into the modern study of the “special”. Under this background, the discipline of Chinese legal thought history arises in the early 20 th century as an independent branch of law science. Since then, the legal thought history become in China has its own unique research objects, research methods, etc.The third chapter is mainly in the field of general history. Although the status of Chinese legal thought history is not as good as the Chinese legal system history at the first half of the 20 th century, several representative works also show the basic shape of Chinese legal thought history. This part will mainly introduce Legal Thought History Ding Yuanpu, of the Chinese legal history, Chinese Legal Thought History of Yang Honglie, Speech of China's Legal System History and Chinese Legal Thought History of Qin Shangzhi.The fourth chapter is for the study of the periodic history. At first half of the 20 th century, the study of Chinese legal thought history is relatively abundant in general, but mainly concentrated in the pre-Qin period. The study of pre-Qin legal thought is top priority in the study of legal thought in China. There are a lot of special works about the pre-Qin legal thoughts.The fifth chapter is monographic study. This part is mainly about the study of philosophical foundation of the ancient Chinese legal thoughts and Chinese law system.The final conclusion part is about the subject development prospect, in the hope of looking for the way of discipline breaking.
