Establishment of China-ASEAN Free Trade Area is envisaged that in November2000held in Singapore Chinese and ASEAN leaders during the session. At present, China-ASEAN Free Trade Area is being carried out which can be said to have entered the formal implementation stage. In2002, China and ASEAN signed the "Framework Agreement on Comprehensive Economic Cooperation" after the "early harvest" products of the tariff reduction process had been started since2004. In addition, the two sides in November2004signed the "Agreement on Trade in Services","Dispute Settlement Mechanism Agreement on Trade in Services" and other documents, jointly developed a series of rules and regulations. Of particular importance is the "service trade agreement" and "Dispute Settlement Mechanism Agreement on Trade in Services," The signing of them as the two sides in July2005launched a comprehensive tariff reduction process to remove the obstacles. This article from a legal point of view China-ASEAN Free Trade Area to discuss issues related to the hope that the promotion of China-ASEAN Free Trade Area and to promote academic research related benefit. January14,2007, Premier Wen Jiabao and the leaders of10ASEAN countries under the witness, China and the10ASEAN countries in Cebu, Philippines signed the "China-ASEAN Framework Agreement on Comprehensive Economic Cooperation Agreement on Trade in Services." China-ASEAN Free Trade Area framework with other countries and regions that have signed the first agreement on trade in services, is following the "trade in goods agreement", the China-ASEAN Free Trade Area has made significant progress in another. Its sign will effectively promote China and ASEAN economic integration, to further promote bilateral openness and development services, to ensure that in2010as scheduled, fully completed in China-ASEAN Free Trade Area has laid a more solid foundation. The author believes that in order to protect China-ASEAN Free Trade Area for the smooth operation more quickly promote bilateral economic development, China-ASEAN Free Trade Area of the legal issues of trade in services is essential.This dissertation is divided into six chapters:The first chapter discusses the China-ASEAN Free Trade Area of the basic overview, China-ASEAN Free Trade Area as well as the legal basis for China- ASEAN Free Trade Area of the organization system.The second chapter discusses the China-ASEAN Free Trade Area Framework Agreement on Trade in Services Review. This chapter first describes the China-ASEAN cooperation to carry out the significance of trade in services. By analysis of the China-ASEAN Framework Agreement on Trade in Services of the main content, the author pointed out the characteristics.of the latest development of China-ASEAN trade in services.Chapter III discusses the China-ASEAN free trade zone service trade empirical study, China and the ASEAN Free Trade Area Service Development of trade cooperation between China and ASEAN trade in services as well as the level of development status.Chapter IV China-ASEAN Free Trade Area Service Trade problems, this section analyzes the FTA between China and ASEAN trade in services problems, from four aspects to analyze the China-ASEAN free trade zone service trade the reality of defects exist.Chapter V discusses the China-ASEAN free trade zone service trade dispute settlement mechanism. This chapter first describes the China-ASEAN free trade zone service trade dispute settlement mechanism resulting necessity, followed by analysis of the China-ASEAN Framework Agreement on Comprehensive Economic Cooperation Agreement Dispute Settlement Mechanism of China-ASEAN free trade zone service trade dispute settlement mechanism followed legal principles and purposes, the last of the China-ASEAN free trade zone service trade dispute settlement mechanism of the sources of law discussed.Chapter VI discusses the improvement of China-ASEAN trade in services Development. This paper presents North America-the main EU member states experience in the development of trade in services. Second, improve the service trade between China and ASEAN to promote competitiveness factors and promote China-ASEAN international trade in services specific countermeasures.
