Innovative Land Supervision System Research Under The Comparative Perspective Of Domestic And Foreign Regulatory Regime

The establishment of national land supervision system is majordecision to implement the scientific outlook of development and the moststringent land administrative system. Using new holistic institutionaleconomics as basic analytical framework and a variety of analyticalmethods, this thesis is based on the Russian and other five countries‘national land supervision in comparison with China‘s nineindustry-related regulatory regimes, exploring the theoretical foundationof China‘s land supervision, the nature of the right source, system mode,functions and responsibilities, operation mechanism and resourcessupport from level of specification and empiricism, to support for thereform and innovation of China’s land supervision study.There are three main theoretical basis of innovative land supervisionsystem including the regulatory body building, new public administrationand land macro-control. Use the interests theory and governmentresponsibility theory to explore the source of land supervision right, wefind land supervision is administrative supervision wielded by centralgovernment to local. The root of land supervision system is the nationalpowers of the land allocation pattern and its mutual relationship. Landsupervision right is the important guarantee to balance interests betweencentral and local government, to control the discretion of localgovernments, and to monitor local governments to implement landadministrative responsibilities.According to The General characteristics of the land supervisionsystem are large district system, Semi-independent form and three levelland supervision institutional frameworks. This institutional modelconforms to the existing constitutional system, the national conditions ofresources and current land administrative system. Compared with thedomestic and international regulatory regime, China‘s land supervisionsystem has successful experiences of target people, leadership system,framework mode, internal leadership and related functions. Accordingly, land supervision duties turn to reasonableness and pay more attention onstrengthening cooperation with local government. It stands for socialequity and justice force of the citizens‘rights. The land supervision rightwill further strengthen and increase inspection right, right to question,right to redress, administrative enforcement law, suggestion right,adjudication, evaluation rights, right to participate and prosecution rightetc.The core conception of China‘s current land supervision system iscoordination. Land supervision in China has basically formed mechanismsystem of politics–administration; functions–structure; decisionmaking–implementation–monitoring; intergovernmental;inter-ministerial and social coordination. Land supervision system inChina has built three core works including routine supervision, auditingsupervision and special supervision that are basically supported by onlineland supervision, investigation and analysis of situation observation.Current Land supervision system lack of democratization, so improvingthe mechanism for public participation, building land supervision impactassessment and implementing performance management will become theinnovative direction.According to legitimate, independent, impartial and efficientprinciples, it must strengthen the support of political resources, humanresources, financial resources and information resources. The mainsolution are strengthening land supervision legislative construction,increasing staffing and technical support, carrying out related training,adding central budget, promoting information technology and integrationproject, disciplining the investigation and survey.
