Intellectual property becomes the research focus of academia in recent years, butmost paper is study in the area of the law. Starting from an economic perspective andindustry perspective, based on the foreign literature, and combined with the reality of ourintellectual property, this dissertation uses theories of the industrial economyscience,economics and management science to study systematically "level of development of theChina Intellectual Property-The economic contribution of the Chinese intellectualproperty rights-the future direction of China’s intellectual property rights”. The studyuses the methods of a combination of macro and micro and a combination of quantitativeresearch and qualitative analysis, further more it accomplishes the study by econometricresearch, interviews, research, case studies and statistical analysis. Improvement andinnovation of this dissertation is mainly reflected in the following six aspects:First, the dissertation buildes a set of the evaluation index system of intellectualproperty powerful country, and based on it finds of the level of development of China’sintellectual property rights. At present, what level is China’s intellectual propertydevelopment in the end? How much gap with the real powerful country? Initially thedissertation proposes the connotation of the intellectual property power, concises thecharacteristics on the basis of the world’s leading intellectual property developed countries,builds the evaluation index system of intellectual property powers based on the SMARTprinciple, analyses the level of development of the major countries using factor analysis,and gives the overall level of China’s intellectual property development which is China isnot a intellectual property powerful country. Evaluating the level of major countries, wefind that the United States, Japan and Germany are the intellectual property power, whosecomprehensive strength are the top three. Intellectual property in China has largerquantities and faster development speed, but the high level of patent is less, degree ofinternationalization is lower, intellectual property protection is weak, patent influence islittle, technology trade deficit is large. These conditions indicate that China’s intellectualproperty quality, efficiency and level is lower. There is a large gap from the intellectualproperty power, and there is a long way to go.Secondly, judge the level of development of China’s intellectual property by patentquantitative analysis from the industrial point. Select a representative field from thetraditional industries and emerging industries, respectively, analyse their patent level tojudge if their patent portfolio can support the industrial development. Based on the quantitative and qualitative methods from the life cycle, the patent holder, technologyfield, regional distribution etc, the dissertation analyze the patents to reveal thecompetition pattern and development trends of the technology field. Study found thatintellectual property in China is weak, foreign enterprises hold the dominant position, andthe technology power is insufficient to support industrial development. Domestic patentsmost are utility model, the main technical content is not high, and technologydevelopment is relatively later. In comparison, foreign companies patent portfolio isearlier, patents have higher patent quality and better economic benefits. Foreignenterprises master the core technology, leading the forefront of technological development;with continuous innovation capacity; large foreign enterprises are grabbing the market,technical monopoly is forming.Third, analyse the level of corporate intellectual property development, regard Tianjinas a example, with the use of a variety of analytical tools, carried out the microscopicpoint. In recent years Intellectual property has a rapid development, there are certaintechnical reserves and intellectual property accumulated, the awareness of intellectualproperty is increasing, intellectual property organization and management is developing,the concept of intellectual property and technical standards is forming, the coretechnology is in its infancy. Compared with foreign multinational comparison, there is nosystematic and targeted conservation strategies, the overall technological level is weak,patent quality is not high, the internationalization of intellectual property lages behindseriously, technical standards and patented technology is parted, awareness and ability ofthe use of patent information is lack, intellectual property business is still relatively junior,lack of intellectual property professionals become bottlenecks, core technology and keytechnology is lack, intellectual property accumulation is weak. Surround by multinationalcompanies, intellectual property in China faces with the risk.Fourth, on the basis of the provincial panel data, the dissertation study the interactionof intellectual property to intellectual property and to other variables. The results showthat:(1) the intellectual property system performance continuously enhance theinterpretation of economic growth;(2) the performance of the intellectual property systemin economic growth in different regions is different;(3) Intellectual property system andhuman capital and industrial environment interaction was significant, the interaction ofFDI is not significant, the market system a lot of time show an alternative or inhibition tothe intellectual property system;(4) intellectual property system itself graduallyimprovemt is the important aspect to promote the growth of the intellectual propertysystem performance.
