Study On Marine Fishery Rights Transfer And Compensation Mechanism

China is one of the countries who have the rich marine fishery resources in the world. Thedevelopment and utilization of fishery resources has made outstanding contributions to marineeconomy and national economic development. In recent years, many of the problemsaffecting the development of fisheries gradually attracted people’s attention, including thedislocation of the legal status of the fishermen and the fishery’s economic status, fishermen’s"lost sea" issues is not as important as the farmers "lost land" issues, the trend of fishermenhave been marginalized will inevitably affect the sustainable economic development ofChina’s fisheries. Therefore, how to establish the marine fishery rights transfer andcompensation mechanism has become an important task to be solved.This dissertation analyzes the problem of our country current fishery rights transfer andcompensation, through drawing lessons from domestic land, grassland, woodland and foreignfishery rights transfer and compensation, attempts to put forward the establishment of China’smarine fishery rights transfer and compensation mechanism, and put forward a system viewon how to establish the security system and the implementation of specific strategies. Thespecific contents and results are mainly embodied are as follows:1、This dissertation finds useful suggestions of the establishment of China’s marine fisheryrights transfer and compensation mechanism by make full use of our country farmland,grassland and woodland compensation experience and research in Japan, Korea, Europe andthe United States National fisheries transfer compensation case,combine the nationalconditions of our country.2、This dissertation proposes the establishment of marine fishery right transfer andcompensation system. Propose the route choice of China’s marine fishery rights transfer modelfrom the dynamic mechanism, market mechanism and mechanism of macroscopical,on the base of the analysis of circulation theory and interest game. This article discuss theestablishment of compensation mechanism from several aspects on the fishery rightcompensation goal and the principle, object and focus, contents and standards, methods andprocedures, standards of measurement and method,especially focuses on the fishery rightscompensation quantity measurement standard and method.3、This dissertation proposes the security system of China’s marine fishery rights transferand compensation mechanism. Perfect fishery law system to establish legal safeguardmechanism, strengthen piscatorial generator protection of the legitimate rights and interests;regulate the circulation market, develop transfer intermediary, formed a sound marketsupporting services; establish social security system in the fishing village, transfer theiremployment, help fishermen learning; establish or improve existing fishermen cooperativeorganization; help the fisherman venture financing, increase unemployment relief funds;establish China fishery insurance system for the fishery right compensation.4、This dissertation put forward the implementation countermeasure of our country marinefishery rights transfer and compensation mechanism, in China’s marine fishing rights andculture rights protection, put forward clear waters, the ownership of tidal flats, redistribution ofgovernment, collective, and fishermen’s interests, establish the transfer mechanismcountermeasure method of fishermen who lost the income; analyses obstacles and problemmay occur in the implementation of marine fishery rights transfer and compensationmechanism, put forward the strategy to build transfer mechanism, perfect the system offishery property rights, integrate the function of the government.
