Applying documentary material,specialist interview and discussion, questionnaire,investigation and so on,the author analyzed the concept, basic elements and process of regulation,the reason and present situation of regulation of professional basketball industry in china. And based on regulatory experience of professional sports industry in U.S.A and optimum regulation-and-practice pattern,the author drew the outline of the regulatory ought-to-be pattern of professional basketball industry in china,and proposed the policy proposals of regulatory reform, in order to promote the development of our professional basketball industry with health and continuation.The fundamental conclusion of analysis:(1)The monopoly,externality and message asymmetry will cause not to attain the most optimal condition in resource distribution in our professional basketball industry,which has provided the possibility for governmental regulation.On the other side,there is still much market deficiency in professional basketball industry in china on the current phase.Hence,on certain terms,the government still needs to implement positive regulatory policies,during a longer period when the market mechanism cannot reach the designated position.(2)The governmental regulation system of professional basketball industry in china is a typical kind of regulatory pattern of division of power,which still has some problems.Firstly,the regulatory organization was set up unreasonably,whose function and target are obscured.Secondly,the overt extent of legislation is not enough and the regulatory system of laws and regulations is not perfect.Thirdly, regulatory capability is defect and regulatory quality is not fine. Fourthly,over and defect regulation,offside and vacant regulation coexist.Moreover,regulatory action of organization still lacks the relevant restriction.Finally,the beneficial groups of clubs, especially consumers,do not still become mature. (3) The American government does not establish the special regulatory organization to the professional sports industry,but implements administration to it in division of power and level by means of three systems of legislation,judicature and enforcement.(4) Regulation reform of our professional basketball industry has own particularities in its nature and external environment,and in market failure and deficiency.(5)The ought-to-be pattern of professional basketball industry in china should to be the relatively independent and centralizing organization set up or reformed,affiliated to the governmental department relevant in charge,and would head for independence step by step.The policy suggestions of governmental regulation reform of professional basketball industry in china:(1)The promotion of regulation reform should begin with the reform of property right,which would make clubs become true market bodies,so as to establish the base of micro enterprise bodies needed by governmental regulation.(2)Beginning with regulatory legislation promotes regulation reform.(3)The regulatory impact assessment should be established to improve regulatory quality by introducing cost-benefit analysis on regulatory policies.(4)The independent and powerful benefit groups should be brought up.(5)The restriction to regulatory organization should be strengthened.(6)Regulatory reform strengthened and loosened in order should be promoted,competition should be introduced and stimulating regulation should be implemented. (7)Regulatory organization and anti-monopoly organization should cooperate and link up each other.(8)Governmental regulation and professional self-discipline should cooperate and replenish each other.
