Civil Rights Consciousness And Its Cultivation Under The Network Environment

Civil rights consciousness refers to the citizens’cognition, understanding and attitude of their civil rights pursuant to the law. It is the choice of the ways of people to realize their rights, and it is also a kind of psychological reflection on how to remedy when people’s rights are violated. It constitutes the core of citizen consciousness and the spirit of the constitution. As the embodiment of modern social consciousness, civil rights consciousness is the psychological foundation of modern democratic politics’establishment and development, is the ideological guarantee of subject of market economy’s independence, and is the important symbol of establishment of legal system modernization. The cultivation of civil rights consciousness is a long-term and arduous historical task. The development of the Internet provides opportunities for the growth of the civil rights consciousness. The civil rights consciousness is constantly developing under the network environment, however, sudden unexpected network events reflect disordered state of the civil rights consciousness under the network environment. Therefore, a comprehensively systematic research on positive establishing civil rights under network environments, to enforce the coordination and integration of civil rights between virtual network and reality from disorder and conflict, is necessary.This thesis performs a comprehensive and systematic analysis of the issue mainly with literature analysis method, comparative analysis method, systematical analysis method and social positivism method and etc. Moreover, this thesis also adopts inter-disciplinary method by introducing the study of strategy, economics, management and other related principles. Deep analysis on the issue from various perspectives is trying to make the argument more convincing and empirical, so that the proposed suggestions of improvement will be guaranteed to have pertinency and maneuverability.The research idea of this thesis follows the steps of raising, analyzing and solving issues. The basic theory of civil rights consciousness under the network environment is presented at the first part, which specifies the issues of civil rights consciousness under the network environment as follows,(1) citizens are lack of awareness on the scope of civil rights under network environment,(2) citizens are short of positive awareness on the compliance of regulations in terms of their rights under the network environments, and (3) civil rights consciousness becomes negative due to lack of right protection under network environments. The second part of this thesis analyzes, detects and proves the influence and execution mechanism of economic factors, political factors and social factors on civil rights consciousness under the network environment. The third part of the thesis proposes an ideal model of civil rights consciousness under network environment to realize the positive awareness of civil right, compliance of regulation, and necessary protection. Finally, from the framework perspective, this thesis presents an overall architecture to cultivate the civil rights consciousness under the network environment, and corresponding suggestions on factors affecting cultivating civil rights are also illustrated. In a summary, the thesis discusses the basic theory of shaping mode based on the reality of China, and reviews and modifies the bottom-up oriented individual rights rivalry mode. It clearly puts forward with specific key points to cultivate civil rights consciousness under the network environment as follows,(1) reasonably establish network culture to achieve positive awareness of civil rights consciousness,(2) utilize the positive influence of network media to encourage the compliance of regulation on civil rights consciousness, and (3) develop the cultivating paradigm of legal practice to ensure the rational implementation of civil rights consciousness.
