Harmonious labor relations is the basis of a harmonious society and an important part, it not only affects economic development, but also affect the social stability. With the reform and opening-depth development, Chinese enterprises highlight the growing contradictions in labor relations. Coupled with the impact of the international financial crisis, academic studies on enterprise's harmonious labor relations have also been warming up. However, these studies have generally stopped at the right description of the status of labor relations in enterprises, not a very good explanation of the nature of harmonious labor relations and its operating principle.After reading a large number of relevant theoretical literature at home and abroad, I, based on the workers' human capital property rights as the main line, have corresponding theoretical studies on enterprise's harmonious labor relations, and find that the nature of enterprise's harmonious labor relations is a rational allocation of economic interests between human capital property rights' owner and physical capital property rights' owner and their agents, and realization of human capital property rights of laborers is the key to build enterprise's harmonious labor relations. Therefore, I explore conditions of human capital property rights of workers and harmonious labor relations in various historical periods in Chinese enterprises, analyze system obstacles to build enterprise harmonious labor relations in the transition period, discuss the relevant experience of developed countries, and put forward concrete implementation mechanism through the establishment of human capital property rights of laborers to build enterprise harmonious labor relations.This article starts according to the following exposition of logical thinking: first, studying and combing theoretical achievements about labor relations at home and abroad is to erect the theory platform for this study. This article also analyzes in detail each meaning and essence of the human capital property rights and harmonious labor relations, as well as their interaction mechanism. Then, the evolution method of institutional economics is used to analysis of human capital property rights of workers and enterprises harmonious labor relations situation and their mutual relations in different periods of our country. Subsequently, I analyze system obstacles and many reasons for their formation to build enterprise harmonious labor relations by human capital property rights in the transition period. Furthermore, in order to learn Western countries' experience of building enterprise harmonious labor relations by the human capital property rights, this article respectively researches implementation mechanisms of human capital property rights of workers in the United States and Japan, searching for useful lessons. On this basis, author proposes specific mechanisms of achieving human capital property rights of workers to build enterprise harmonious labor relations: the Government's main task is to establish human capital property rights systems and cultivate human capital markets; employing unit mainly to build a new enterprise system sharing by human capital property rights and material Capital Property.
