Research On The Design Of Property Rights' System Of China's State-owned Enterprises

From the beginning of the "power delegation and profits transfer" of the state-owned enterprises (SOE) in 1980s, China's SOE reform has been driven with the logical thinking of property rights' (PR) reform, moreover, the property rights' reform has become a fundamental issue that we can't ignore. Currently, the reason why our government and the academic circles pay close attention to the PR issue is that the problems in PR's reform have been solved not well and become the most crucial of the SOE's adapting to the market economy, the most severe in the SOE reform.In China, the PR's reform generally includes aspects as follows: firstly, by the PR's reform, the many-faceted market subjects will be encouraged and developed, so that the governmental capitals can enter, strengthen or participate actively in certain economical fields to adjust, strategically, the state-owned economy and to reorganize the SOE; secondly, the state-owned assets supervising and managing system is to be established by the classification and the arrangement of the PR. With the establishment of the subscriber system in the SOE, the governmental capital' s management of the people, affairs, and assets will be joined, so that its ownership will be truly secured; thirdly, with the modification of the PR relations, the inner managing structure of the enterprises will be perfected and the new contractual relationship, or the new duty-right-profit relationship between the succedaneums, managers and the employees will be established to improve the performance of the SOE.The reform itself is a process of the systematic innovation and redesign. According to the demand of the development of the socialistic productive force, the process of the reform in China is exactly a process of the innovation and redesign for a more efficient economy system that can release the productive force and accelerate its fast development. The aim of the PR's reform of the SOE lies, fundamentally, on the perfected distribution of the resources so that the development the socialistic productive force will be better promoted. As a result, the researches on the issue of the PR's reform of the SOEcontribute a lot not only to the enrichment and development of the modern PR economic theories, but also to the improvement of the PR's reform of the SOE in China, theoretically and practically.The research subject in this paper is the design of the PR system of the SOE in China. Under the guidance of the Marxist theories of property rights, the achievements of the foreign and domestic theories of PR and enterprise governance are absorbed critically. With the basically theoretical analysis, the international experiences are summarized systematically; the 20-year historical process of the SOE reform, since the establishment of the open and reform policy in China, is analyzed further and also the troubles and problems of the SOEs are facing, on the basis of which the types of the SOE, its role-taking and target-choosing, the basic structure of the PR' reform of the SOE, and the adopting of the governmental activities are designed scientifically, furthermore, the systematic designing principles and the structure of the enterprise governance management, and the administration and supervising of state-owned capitals, are raised, microcosmically and macrocosmically respectively.
