Theory Analysis And Pragmatism Study On Land Expropriation System Reformation

Land expropriation is a kind of land policy widely adopted by many countries in the world. The current land expropriation policy in China was formed in planned economy, which, at that time, exerted positive effects on the national economy. However, with the development of socialist market economy, its internal and external drawbacks gradually came out in the wash. Social contradictions resulting from land expropriation have occurred, especially those serious problems in terms of decreasing living standards and unemployment of the farmers, which affected the long-term stability of the society and eventually hindered the establishment of a harmonious society. Therefore, it is commonly acknowledged that reforming the current land expropriation system is of desperate necessity, involving those imminent tasks like studying, exploring and establishing a new land expropriation system.Nanjing City is one of the 9 pilot cities first approved by National Land Resource Ministry to launch reforms on land expropriation system. Based on the writer's involvement in the whole process of the research on reforming land expropriation system in Nanjing City, systematical investigation into the domestic and foreign literature concerning land expropriation system, its own working experiment in the city, and reflections and explorations on the reform of the system, the following paper comes out.This paper firstly presented the concept and significance of land expropriation and land expropriation system, suggested the purpose and significance of the current study and introduced the theory study and practice progress concerning land expropriation system at home and abroad. Meanwhile, to lay a theoretic foundation for the study, the paper gave a brief introduction to the fundamental theory related to the system. This included such theories as land system, land property right, land economic attribute, land leasing and pricing, land location, center zone and continuing development of the land. Besides, the methods and principles by which the land is evaluated were also presented since land expropriation involves factors like the value and price of the land itself.Following the review and reflections on the development of Chinese land expropriation system after the foundation of the Republic of China , this paper further discussed the policy framework and characteristic of the current system, laying emphasis on its main drawbacks and exploring the policy causes for these drawbacks.Drawing on the study mentioned above, taking Nanjing City as an example, a further investigation and discussion on the current situation of land expropriation system, especially the existing problems as well as causes for these problems, and concepts and relatedmeasures as regard to the perfection of the system have been further presented.Finally, from a broad view, the paper detailed a systematic and complete discussion on the concepts and countermeasures on the land expropriation system and advanced its own suggestions, which covered the following items: regulating the execution of the right of land expropriation, launching the strict protection system for the farmland, conducting land selection while referring to GIS in land expropriation project, perfecting the property system for the collective land in rural areas, exploring the scientific generating mechanism of land compensation fee, comparing and selecting the settlement method for agricultural population, establishing land expropriation procedures based on fairness, openness, and justice, legislating for farmers' dismentled houses, adopting policy of land reserve and constructing new land expropriation system in the land expropriation. Finally, a further research in this area is advocated.
