| Throughout the history of the world economic development, the technical level of the automotive industry can represent a country's level of industrialization to a certain extent. Automotive industry in China has long been under the guidance of the theory of comparative advantage and the technology borrowed theory which leads to the "market for technology" policy. Thus, China is becoming the production base of the world automotive industry and the Chinese independent brand automobile enterprises has become the vassal in the global strategy of multinational companies and ultimately failed to form independent core patents, strong brand and technical standards. Despite the current dominance of traditional power automobiles in the global automobile market, the new energy automobile has become the common future choice of the world automotive industry, because of the double dilemma of the energy and the environment. In the new energy automotive industry, there have already appeared many technical solutions, but no one has reached completely finalized and without the perfect group of core patents and the uniform international technical standards system yet.From the current situation of Chinese auto companies, their weakness is not in manufacturing, but in the intellectual property rights. Only based on the innovation of the independent intellectual property rights can realize the effect of path-creation. Therefore, Chinese independent-brand automobile companies can successfully rely on their own technical ability to finish the dominant design of the new energy automobile, and as much as possible to have the core technology or essential patents in related industries. Moreover, they try to make the uniform technology standard of the new energy automotive industry through the legal procedures and even the international standard. With all the methods mentioned ahead, they may successfully accomplish the standard monopoly.This thesis intends to set up the multi-level, multi-dimensional, both offensive and defensive Green IPR Strategy of new energy automobiles and reveal the catalytic function to encourage the creation and diffusion of core patents and independent brands of new energy automobiles in China. Firstly the thesis expounded the theory of the new energy vehicle development strategy, the innovation strategy of new-energy vehicles and the green intellectual property strategy; then impoved SWOT analysis method to identify the environmental impact of internal and external factors in the development of new energy vehicles and new energy vehicles.The author thinks the Green IPR strategy is a realistic choice for the development of new energy automobiles under the double dilemma of climate change and energy crisis. The strategy have to consider the environmental public benefit in the independent innovation circulation system in order to build up the framework of the comprehensive green patent strategy and green trademark strategy and their own realization mechanism, which are the main parts in the thesis.In view of the patent status of new energy vehicles, Chinese own car firms are required to make the green core as the basis of strategic scientific formulation and effective implementation of the power to motivate high quality green patent output mimic the path of innovation, the development of green technology to achieve the introduction of digestion and absorption of technology innovation. Open and cooperative innovation model should be flexible and use the green patents open and sharing of strategies and innovation resources aggregation and integration effect. Environmental factors as a reasonable defense to deal with patent infringement disputes that may arise in the future commercialization of the "standard" trap. Green patent information management, green patent asset management and green patent risk management may achieve the goal of capacity building of new energy automobiles.Selected on the basis of the average consumer of new energy automobiles, green consumption trend is not based on a green patent but a green trademark and its marketing campaign. This is recommended to determine a unified "green" standard, to encourage new energy auto companies to independently design green trademarks and establish green brand awareness. Rigorous review and regulation of new energy automobiles, green trademarks and environmental claims from the legislative, executive and judicial level, put an end to "greenwash" marketing practices in order to create a real, reliable and green consumption environment for the new energy automobile market.The BYD Company is a typical representative of new energy automobiles in China. The thesis finally take it as the example of an empirical analysis of the intellectual property rights strategy, which proposed that the BYD company needs a greenization of its current strategy to promote the future development of new energy automobile project. The thesis tries to construct a set of experimental project for Green IPR Strategy of the New Energy Automobiles of BYD Company. It is far-reaching practical significant to fully uncover the advantage of backwardness of Chinese independent automobile companies and to achieve the striding development of the industry. |
