Research On Check And Balance Mechanism Of NBA

This dissertation made a study on the basic theory of check and balance mechanism of NBA, NBA Arbitration, labor power, profit, power check and balance mechanism by method of literature, visiting, mathematical statistics, questionnaire survey. Through comparing with NBA check and balance mechanism, it came to a conclusion that CBA is in a non-balance station. Basing on this, this dissertation probed into the reason that caused the non-balance station of CBA. Then, this dissertation advanced some advice that improves the non-balance station of CBA. The conclusions are following:1.The definition of checks and balance mechanism of NBA is: NBA league makes NBA subject attain balance station by means of NBA laws and it'fuction, structure when NBA subject attain balance indeed. NBA checks and balance mechanism is made up of external, central, interior checks and balance mechanism. Interior checks and balance mechanism includes negotiating mechanism, corporation system mechanism. The relationship between negotiating mechanism and corporation system mechanism is basis and replenishment.2. Labor power checks and balance mechanism includes NBA draft system, player trade system and player salary limitation system. NBA draft system not only ensure NBA league take up global basketball talent, but also improves the chance of selecting excellent rookie for weak team; NBA trade system includes contract trade and free Agent signing, the former is suitable for player exchanging who is under contract and the latter is suitable for free agent negotiating, signing. Salary limitation system of NBA player prevents teams from enlisting super player and player from gobbling up owner'profit.3.The profit checks and balance mechanism of NBA league includes the marketing system of NBA TV broadcast right, marketing system of NBA authorizing products, controlling system of NBA team numbers and region distribution, Salary limitation system of NBA team. The marketing way, which is adopted by NBA league, is the combination way between central marketing and decentralized management. Compared with Europe professional sport league, this marketing way not only prevent revenue gap between different NBA teams, but also improve the managing zeal of NBA team. The target of controlling system of NBA team numbers and region distribution is to prevent galloping competition for commercial market and fan market between NBA teams, likewise, the target of marketing system of NBA authorizing products and Salary limitation system of NBA team is to prevent revenue gap between different NBA teams.4.The power checks and balance of NBA aims at the following three aspects: negotiating right, residual rights of control and residual rights of claim. The relationship among these three rights is: the negotiating right is the premise for residual rights of control and residual rights of claim, the residual rights of control and residual rights of claim is the target for negotiating right between labor and capital.5. NBA Arbitration is the neutral system, which is set up by negotiating way between labor and capital. It includes Grievance Arbitration and System Arbitration. The former mainly settles relatively small contradictions and the latter settles relatively small contradictions between the labor and capital of NBA whose target is to ensure healthy and steadily development of NBA league.6. This dissertation came to a conclusion that CBA is in a non-balance station. After close analysis, the main reasons, which caused the non-balance station of CBA, are: the administrative system under planned economy, the whole nation-training mode of competitive sport, lacking power supervises for it'exercising, controlling department 'loose restrain to CBA league and so on. Basing on this, some advice was advanced to improve the non-balance station of CBA, they are: the basketball administrative central transferring power to CBA club, CBA club investing shared to establish CBA basketball talent base, establishing supervise organization, strengthening restrain to CBA league and so on.
