The last 100 years has witnessed the transitional process from the education of elites to that of masses happening in the Chinese higher educational system. With the transformation of this system during the same process, the colleges and universities have been struggling for the realization of the autonomy authorized by the Higher Educational Law on the basis of Educational Law, nevertheless they are charged by more and more of their students on the courts. Consequently, the higher educational autonomy has become the target of both the blame and the academic research.In spite that the research on the high educational autonomy has concentrated on the study of different forms of that autonomy, the fundamental reasons for which lie in the theoretic construction. Aiming to establish a reasonable system for the realization of the high educational autonomy, my article, by means of constructing the basic theory, not only analyzes the reality, but also advocates some proposals on its reforming.Until present, the autonomy of high education is a term just employed by academics since neither the state policies nor the laws have referred to it. Another term, "The Administering Autonomy of Higher Education", which is closest to the autonomy of high education, was used only in 1985 in "The Decision by the Communist Party of China on the Reforming of the Educational System". Most scholars have deemed the rights of the schools authorized by the Educational Law or the seven legal rights by the Higher Educational Law as the rights of autonomy. Therefore, the starting point of the research should be the definition of the autonomy of high education. Following this, my article makes an inquiry about the reasons for the autonomy, which are also the values behind my research. As the study on "what and why" helps to further the development of the high education, the author has tried to put the theory into practice through the defining of the types of the rights enjoyed by the higher education.
