Study Of The Juvenile Justice System

The first juvenile court in the world was established in state Illinois of the US in 1899, which is regarded as the beginning of the Juvenile Justice System .The Juvenile Justice System is the main legal system applied to dealing with juvenile delinquency. However such a legal system has not been established in china because of quite a few factors. This article discusses the main topics in the field of juvenile justice system and tries to find out ways of set up the Juvenile Justice System in China. There are five chapters about them.In chapter one we tract back to the origin of the Juvenile Justice System and talk about the values of such a system.. And then social background and basic theories of the Juvenile Justice System are discussed in chapter two. It's believed that correction according to individual instead of pure punishment is the important theoretical foundation of Juvenile Justice System. After the introduction of the juvenile justice system in the two former chapters, we focus the basic notion and definition of the juvenile justice system. It is to differentiate the juvenile from adult criminal. That's to say, children cannot be treated as criminal. Nothing can be more significant than make them return to society. Penalty is not the aim. In the chapter four, we pay attention to the realities in China of legal system dealing with juvenile delinquency and crime, we think current system bring some side effects which affects the young negatively. Therefore we try to present some initial ideas to build up the juvenile justice system in our country. Among them, the legislation of juvenile laws, the establishment of juvenile court, the substantive and procedural laws are discussed in detail.
