This dissertation mainly studies food safety, and the important problem it wants to explain is that which the main goal of food regulations is between regulating the food hygiene, quality and safety to guarantee the health of consumers and holding the order of food market. Firstly, this dissertation analyzes the food regualations including its contents and nature, the process and reasons of its being established, the attitudes towards it from different agencies and persons such as administrative departments, consumers, and scientists, the procedure of the practices of the law, the limit of authority of administrative departments, and the strategies of vendors. Secondly, this dissertation takes milk and GMO as an example to analyze in details the relationship between the health of consumers and the order of market, and how food regulations balance the above two different kinds of interests.Besides the policies of food safety of China, the dissertation analyzes the difference between China and EU, and China and Russia. Because of the limit of reference material, the comparison between them is not comprehensive, but selective.This dissertation is divided into eleven chapters.Chapter one introduces the laws of food hygiene, and analyzes the functions of them in guaranteeing the health of consumers and holding the order of market. Chapter two examines how the laws of food quality hold the order of market and guarantee the health of consumers. Two aspects which link closely with the food safety are the protection of the interests of consumers and the functions of administrative departments. In chapter three, the dissertation analyzes how the policies and practices of food regulations of a country balance the interests of consumers and vendors. Chapter Four pays attention to the functions of different administrative departments which link closely, and the limit of authority of them. We can find out that from the 1980s to present, the protection of public health has been increased greatly. Especially, in the ongoing discussion of the project of the Law of Food Safety, there are many articles aiming to punish the illegal activities of food producers, in order to protect the interst of legal economic actors and the health of consumers.Chapter five and six introduce the food regulations of EU and Russia briefly. Since 1960s, the aim of EU food regulations has been to seek unity of EU food market. The level of food hygiene becomes more and more higher, which is advantageous to the health of consumers, but in fact, EU food regulations protect consumers through the way that the information of product is to open to them. An example about cigarette: if vendors have stick a label on cigareete that smoking is harmful to health, they are not responsible for the health of the public.The establishing of food regulations in Russia used to be controlled by the administrative departments, but now, the associations become so big that they influence Russia food regulations and food trade policies.The reasons that the dissertation choose the milk products are as follows. Firstly, they are important food for people daily life. Secondly, there are many controversies about the safety and the production of them. Thirdly, there are many links in the production including peasants who produce milk, places which collect milk, processing factories, vendors, consumers, associations, different administrative departments, and scientist research institutions. From the case-study about milk products, we can find the relations and hierharchy between the health of consumers and the order of market.At present, the international debate around GMO is the fiercest one. EU is against GMO, while America is for GMO. The policy of GMO in China is between the two.In last chapter, the dissertation analyzes the relationship between food market and food safety from the view of international trade. The internal food market, the problems and policies about food safety for a country or district exert a direct influence for international trade of food.
