Study On Social Governance Of China’s Insurance Industry

The central topic of this dissertation is the insurance industry public affairs management. The insurance industry public affairs management belongs to the public governance issue because of its non-profit and public character. The global financial crisis has shown that the public affairs management mode of finance and insurance is low efficiency in some extent. Thus, the theory and model of insurance industry public affairs management needs to be reconstructed. Firstly, the development of civil society has brought the changes in principles of governance and social structure. Traditional public management model is partially replaced by public governance model. Secondly, China is transforming toward a society and market economy system which is called "dual transforming stage". It needs the participation of social governance of public affairs management. Thirdly, the trend of economic globalization and international financial integration is irreversible. At the same time, the spread of financial risk has accelerated markedly. Therefore, the insurance sector governance requires the introduction of global governance.Insurance governance theory, as a result of a new theory of effective governance of the insurance industry, corresponds to the post era of financial crisis of the public governance environment changes. Some studies suggest that social governance is the important model and key factor of the governance theory. As the rising third force, Social governance mechanism can break the traditional public governance model that helps to overcome the "double-failure" of government and market. It will resolve the prominent government management crisis and enhance the effect of insurance governance. This dissertation analyzes the mechanism and tool of social governance and brings forward the main goal and basic principle of social insurance governance. Besides, according to current situation of social governance, the paper analyzes the main international trend of insurance governance as well. Thereby, this dissertation researches on some important issues which include operational model, embedded mechanism, optimizing government system and regulatory reform and so on;The social insurance governance has internal specific operating mechanism which can be analyzed from organization and individuality aspects. In the first place, the credible commitment of individuality mechanism is involved credit mechanism, ethical mechanism, incentive mechanism and discount mechanism etc. Secondly, the organization mechanism is including participation mechanism, cooperation mechanism, enforcement mechanism and supervision mechanism etc. The relationship among the different mechanisms is equally complementary, compatible and cooperative that the governance mechanism’s function can make into the synergetic advantage. It applies the social regulation function in cooperating and integrating all kinds of governmental, marketing and social mechanisms for "good insurance governance". The top design is the key element of government system that the social insurance governance mechanism operates collaboratively which will push the reform of public governance and regulatory system and play an important role in "meta governance".It needs to construct macro and micro model of multi-governance structure in order that operates the system of social insurance governance efficiently. In the first place, the "macro model of multi-governance" consists of four basic public governance systems such as government regulatory authorities, market and company governance, social governance and global governance. Secondly, the "micro model of multi-governance" is including social organization, industry organization, citizen organization and citizen movement. The multi insurance governance model is a network governance structure including multiple participation, openness and inclusiveness, cooperation etc. It constructs 4 main supportive systems including: the supportive system of organization, content, internet and legal institution.Emphasis on the important system structure of social governance, this dissertation presents the system of social insurance governance and laws. Besides, it shows the legalization which is the certain trend of social insurance governance. This dissertation also analyzes the main trend of china’s insurance legalization after investigate the gradual process of legalization and the model of law from Britain, America and Germany. Moreover, the paper brings forth the key factor and path according to china’s current status and goal of legalization.The study is believed to help us deepen our understanding of the theory of insurance industry public affairs management. It will also be valuable for the insurance industry to overcome the financial crisis, reduce diverse disorders and regain the market order. Hence, it will prevent market risks and protect the legitimate rights and interests of consumers as well. For the insurance industry, the study is important to achieve " Good Governance ".
