After the Second World War, American government set up H-visa temporary skilled worker program while modifying its immigration law with the escalation of the Cold War and rapid development of American economy and technology. In the subsequent more than 30 years, American government successively set up programs of other properties with J-visa and L-visa programs as the representatives according to its domestic and foreign trends’ needs. The setting and perfection of these programs become one of the pillars for America to attract foreign technical talents. Together with terms and conditions for attracting permanent immigration of skilled workers in other immigration policies of America, they form the dual system of America to attract foreign talents after the Second World War. The academic circle of China has started to research policies and related problems of permanent immigration of America earlier on these important reforms, but it lacked systemic and comprehensive research on temporary worker program, which played an equally important role. So, with domestic and foreign academic achievements as the preconditions, this paper selected the representative H-1B temporary worker program as the research object and the setting and policy development of H-1B visa as the main line to clear up and study related research achievements in American government literature, statistics and academic circle and show the historical changes of the program and its influence to American social and economic development, and the whole temporary worker program system of America was also introduced.This paper is composed of three parts: introduction, main body and conclusions.The introduction part mainly introduced this paper’s background, definitions of concepts, research status at home and abroad, research emphases and difficulties, research significance, research’s approach, perspective, methods, and innovation and shortcomings of the research.Chapter One traced the historical development of temporary skilled worker program of America, including the one before the Second World War with non-skilled workers as the main body and ones like indentured servant,contract labor and temporary agricultural labor. After the Second World War, America set H non-immigration visa in 1952 Immigration Law to attract foreign technical talents and formulated L-visa and J-visa programs of work so as to gradually build the introduction system of temporary skilled workers. This chapter provided a macro historical background and context for readers to understand the main theme.Chapter Two introduced the historical background and causes to establishment of H-1B temporary skilled worker program in the 1990 s, including the reform of American Congress on H labor worker program in immigration law of 1990 and its motivation as well as its relationship with other terms and conditions of immigration, based on which this paper analyzed the process, contents and reasons to adjust H-1B program in 1998 and 2000 respectively.Chapter Three analyzed implementation and effects of H-1B temporary skilled worker program, including analysis on the quantity of H-1B visa, analysis on features of entry workers, and stated several prominent problems in the program, such as Indian H-1B workers under the largest quantity, the transfer of temporary workers into permanent immigrants, introduction of skilled workers and the cultivation of local talents.Chapter Four stated debates on H-1B temporary worker program, including different attitudes all sectors of the community in America and the most controversial ones are: limited quantity of H-1B visa and influence of H-1B workers to local workers.The conclusion part summarized the whole paper, including the development of American temporary skilled worker system with H-1B program as the representative, establishment, implementation and effects of H-1B program, based on which disclosed the essence of American immigration policy and its referential value to China in formulating talent attraction strategy.
