The Analysis Of China's Local Government Environmental Regulation Difficult Problem And Countermeasure Mechanism

Environmental regulations directly relates to economic and social sustainable development. With vast number of land area, obvious geographical characteristics, regional and inter-regional environmental issue that unique from each other, China local government plays a vital role in making environmental regulations. However, due to a late start of China's market economy, political reform has lagged behind, plus long term of local protectionism that has not been completely eliminated, local government in environmental regulation encountered more difficulties. For example, in the development of regional economy and environmental protection, in the inter-regional environmental cooperation between local governments, in the making environmental regulation policies between central and local government, there exist contradictions and conflicts. These issues can not be settled overnight because it not only requires local government who holding the concept of scientific development-oriented and thoroughly changing the development concept and building a resource-saving and environment-friendly society, but also regulating and reining from its system and mechanism, rational dividing its regulation authority and responsibilities between central and local environmental to establish and improve the responsibility of the environmental protection mechanism, regulating competition among local governments and establishing an inter-regional environmental cooperation mechanism, encouraging public participation in the environment issues and achieving environmental cooperation governance between government and the public; assessing local government performance combining with the green GDP index and establishing the performance evaluation mechanism suitable for China's current national conditions, and so on.From China's current environmental reality and the theoretical perspective of government environmental regulation, drawing on the related theoretical achievements and research methods from system economics, development economics, environmental management, public management and game theory, using case analysis and comparative study ,the paper analyses local government environmental regulations which divided into following three levels: micro-view(in-region), middle-view (inter-region) and macro-view (between central and local government) and proposes policy recommendations for the mechanism construction of local government environmental regulations.The 17th National Congress of the CPC explicitly proposed to build a resource-saving and environment-friendly society which precisely responds to the current severely-damaged natural resources and environment. Through an in-depth analysis on the problem, function and role in the ecological environment regulation for local government, this paper attempts to put forward some useful policy suggestions on China's model of economic and social development and environmental governance concept. From this point of speaking, the paper has a strong theoretical and practical significance.The body of dissertation includes six parts altogether. Chapter one is a general introduction of its research background, purpose and significance; defining its core concepts, reviewing status quo of study at home and abroad; illuminating research methods, logical framework and innovation.Chapter two analyses the main governmental regulation and environmental regulation from theoretical basis, classifying the general methods for environmental regulation.Chapter three studies local government's role in environmental regulation and gives a close study on typical case comparison of Japanese local government.Chapter four positions the function and role of China's local government in environmental regulation that analyses the historical evolution of China's governmental environment regulation, environmental regulatory system of local government system, institutional structure as well as the role of local government in environmental regulation.Chapter five focuses on a number of practical problems during the process of environmental regulation for Chinese local government with in-depth analysis on some live cases that firstly from the micro-view to analyze the contradictions between the development of regional economy and environmental regulation of local government; that secondly from middle-view to study the dilemma on inter-regional environmental cooperation; that finally from macro-view to illuminate the conflicts and game-playing between central and local government.Chapter six puts forward the mechanism building of local governmental environmental regulation with Chinese characteristics that firstly need local government to change the philosophy of development and to take green mode of development led by scientific development concept and to build a resource-saving and environment-friendly government; secondly need to clear authority and responsibility for building the environmental protection mechanism by local government; thirdly need to regulate competition among local governments and set up an inter-regional environmental cooperation mechanism; fourthly to construct local government performance evaluation mechanism suitable for China's national conditions within the core of green GDP; fifthly to actively encourage public participation in environmental issues and achieve cooperation governance by government and the public.Finally, in the concluding part, this paper summarizes the difficulties for environmental regulation of local government and its countermeasure mechanism.
