On Administrative Law Regulation Of Medical Ethics Review

In recent years,a number of serious violations of medical ethics have occurred in China,such as "gene edited babies","head replacement" and "Golden rice",which not only seriously damaged the subjects’ legitimate rights and interests such as life,health and personal dignity,but also caused irreparable damage to human rights and interests such as dignity and safety.The frequent occurrence of these incidents reflects that our medical ethics review system is in vain,unable to guarantee the steady development of biomedical research involving human subjects on the track of medical ethics,let alone the function of protecting the legitimate rights and interests of subjects and human beings.Starting from the basic theory of medical ethical review,by systematically sorting out the current situation and existing problems of medical ethical review in our country,it is found that there are some problems in medical ethical review,such as lack of supporting administrative regulations,unclear legal status and basic loss of independence of review subject,uncertain qualitative review behavior and imperfect administrative supervision system.It is precisely because of these problems that the legitimate rights and interests of subjects and human beings cannot be effectively protected.It further analyzes the public administration function of medical ethical review and the characteristics of medical ethical review behavior,and makes it clear that medical ethical review subject has the position of administrative subject and medical ethical review behavior belongs to the category of administrative license.In view of the many existing problems of medical ethics review,we learn from the experience of western countries to regulate medical ethics review and explore the regulation measures of medical ethics review conforming to Chinese national conditions.It mainly includes the following aspects: Strengthening the construction of administrative regulations for medical ethical review,ensuring the independence of medical ethical review,developing unified standard operating procedures,improving the administrative supervision system,and clarifying the administrative legal responsibility for medical ethical review.Through the regulation of administrative law,medical ethics review can take on the function of protecting subjects and human dignity,safety and other legitimate rights and interests.
