Analysis On The Current Situation Of Medical And Health Supervisors’ Allocation And Cognition Of Law Enforcement Ability In A Province

Objective:The ability of health supervision and law enforcement refers to the abilities required by supervisors in the supervision and law enforcement work,which is of great significance to the quality of supervision and law enforcement work.Through a questionnaire survey of medical and health supervisors in the investigated province,to understands the configuration status and cognition of law enforcement ability of medical and health supervisors in the investigated province,analyzes the problems faced by medical supervision,and proposes solutions and suggestions.Methods:From January 2022 to March 2022,a survey was conducted among all medical and health supervisors in the investigated province,and 386 valid questionnaires were collected.The questionnaire mainly includes personal basic information,working status and medical and health supervisors’ cognition of law enforcement ability.Microsoft Excel 2010 was used for questionnaire data entry,IBM SPSS 24.0 and Microsoft Excel2010 were used for data processing and statistical analysis.Results:(1)A total of 396 medical and health supervisors were investigated in this study.Compared with the standard value of the former Ministry of Health for the allocation of medical and health supervisors,the number of medical and health supervisors is less than 90 percent of the minimum standard.The number of medical and health supervisors in four cities and prefectures reached the lower limit of the allocation standard.The Gini coefficient of medical and health supervisors distributed by geographical area,population and number of medical institutions was 0.290452,0.227405 and 0.228012,respectively.(2)Among the surveyed medical and health supervisors,23% were provincial and municipal supervisors,and 77% were district and county supervisors;Male supervisors accounted for 54.4% and female supervisors accounted for 45.6%,with a sex ratio of 1.19:1.In terms of age composition,67.1% of supervisors are between 31 and 50 years old,and 24.9% are over 51 years old.Among the majors,clinical medicine accounted for 26.4%,preventive medicine 25.6%,law 8.8%,and management 7.8%.In terms of educational background,medical and health supervisors with a bachelor’s degree accounted for 54.1%,while those with a bachelor’s degree or less accounted for41.7%.Those who have been engaged in medical and health supervision for less than5 years account for 31.1% of the total,followed by those who have been engaged in medical and health supervision for between 6 and 10 years,accounting for 23.3%.In the composition of professional titles,37.3% were non-professional titles,and junior titles accounted for 27.7%;The number of supervisors with salaries between 3,001-4,000 yuan was the largest,accounting for 35.2 percent,with 136 supervisors.(3)Medical and health supervisors’ cognition of law enforcement status: in terms of their recognition of counterparts,53.1% of medical and health supervisors thought that the supervision counterparts had a high degree of recognition of work;In terms of cognition of the degree of cooperation of counterparts,62.7% of medical and health supervisors thought that the degree of cooperation of supervision counterparts was high;In terms of cognition of resistance to law enforcement,82.4% of medical and health supervisors thought that insufficient supervision personnel was the main problem,58.5%of medical and health supervisors thought that limited law enforcement means was the main problem,and 40.4% of medical and health supervisors thought that limited personal ability was the main problem.Regarding the cognition of the current situation of law enforcement vehicles,44.6% of medical and health supervisors thought that the equipment of law enforcement vehicles could not meet the law enforcement needs;As for the behaviors that deserve the most attention and prevention in law enforcement,41.2% of medical and health supervisors thought that they were resisting law enforcement due to the threat of violence,and 32.9% of medical and health supervisors thought that law enforcement was not in place.In terms of the cognition of factors affecting law enforcement and supervision activities,medical and health supervisors think that the influencing factors are respectively the legal awareness of the supervision object,the law enforcement level of supervisors themselves,the means of supervision and the basis of law enforcement.In terms of cognition,81.3% of the medical and health supervisors thought it was difficult to obtain evidence,59.3% of the medical and health supervisors thought it was difficult to ban,and 57.5% of the medical and health supervisors thought it was difficult to carry out the punishment.(4)In the cognition of law enforcement ability of medical and health supervisors,the cognition of various abilities in order of importance is to master relevant laws and regulations,to investigate and collect evidence,to correctly write health supervision and law enforcement documents,to deal with emergency incidents,to understand medical knowledge related to work,etc.Supervisors believe that the subjective factors in the law enforcement process are,in order of importance,the degree of harm of the case,the nature of the case,and the subjectivity of the mistake.Supervisors believe that the influencing factors of law enforcement level are professional level,subjective state of supervisors,years of medical and health supervision and educational level in order of importance.In terms of the evaluation of the supervisors’ law enforcement ability,23.3% of the medical and health supervisors thought they were strong in all four abilities and could meet the job requirements,while 1.3% thought they needed training and learning in all abilities.At the same time,the abilities of supervisors from strong to weak are the ability to investigate and collect evidence,the ability to write health administrative law enforcement documents,the ability to master work-related medical theory knowledge,and the ability to master work-related laws and regulations.For supervisors to grasp the Administrative Punishment Law,the lowest correct rate is about the punishment type of multiple choice,the correct rate is only 1.55%,the other correct rate is below 60% is the summary procedure of citizens’ penalty,summary procedure of legal person’s penalty,hearing procedures,legal review content and other four questions.Conclusions:(1)The number of medical and health supervisors in the investigated province is insufficient,and the distribution of medical and health supervisors is relatively fair.The supervisory manpower should be actively expanded to meet the actual needs of supervision and law enforcement.(2)The ratio of the medical and health supervisors who are over 50 years old is much high.Supervisors with non-major,not reach undergraduate level or no professional title accounted for a large proportion.Attention should be paid to balancing the educational background and professional composition of the supervisors,and supervisors should be encouraged to participate in continuing education and obtain professional titles.(3)Medical and health supervisors generally think that the salary level is low and lower than that of other units or personnel at the same level;The regulatory counterparts within the jurisdiction have a good degree of recognition of the regulatory work and a good degree of cooperation with the regulatory work;The main resistance to supervision is the lack of supervision personnel;In the work there are insufficient law enforcement vehicles and other problems;In law enforcement,the most important behavior to be taken seriously and prevented is the threat of violence and resistance to law enforcement.The main problem in combating illegal medical practice is the difficulty of obtaining evidence..(4)Medical and health supervisors’ cognition of law enforcement ability is similar to that of other scholars in China,believing that they should have the ability to master relevant laws and regulations,to investigate and collect evidence,to write health supervision and law enforcement documents correctly,to deal with emergencies,and to understand work-related medical theoretical knowledge.It is believed that professional level has the greatest impact on the level of medical and health supervision and law enforcement,and supervisors have a poor grasp of some laws and regulations,so supervisory institutions need to increase the corresponding training and learning opportunities to improve the law enforcement ability of supervisors.
