Normative Study On Fishery Administrative Law Enforcement In China

Since the reform and opening up,the productivity of China’s fishery industry has been greatly improved.At the same time as the fishermen have increased their incomes,there have also been problems such as the depletion of fishery resources,the ageing of fish stocks,and the difficulty of becoming a fish.In order to achieve sustainable development of fishery resources,China has repeatedly introduced laws,regulations and rules to restrict fishing methods,regulate aquaculture and protect endangered aquatic organisms.The implementation of abstract legal documents requires the actual implementation of the fishery administrative law enforcement department.Although the fishery administrative law enforcement has achieved many results,there are still many irregularities.For example,the administrative law enforcement of fisheries is inefficient,and the law enforcement is arbitrary.It is not strictly enforced in accordance with law enforcement procedures,and sometimes there is no relevant law to rely on.This paper studies the current situation and problems of fishery administrative law enforcement,and proposes solutions to the corresponding problems.The aim is to improve the efficiency of fishery administrative law enforcement,achieve fair,just and lawful law enforcement,and achieve the goal of national rule of law.This paper selects typical cases,combined with my actual experience of marine fishing operations,first analyzes the case focus,analyzes the main dispute points,and then counts out the law enforcement normative issues highlighted in the case according to relevant laws and regulations.Furthermore,by consulting the data,the system lists the current situation of China’s fishery administrative law enforcement,and gradually analyzes other major issues affecting the fishery administrative law enforcement norms..Hearing system.The final part of the research is based on the theory of research combined with the practical problems existing in practice,and proposes countermeasures to regulate the administrative enforcement of fisheries.
