Freedom of speech is a basic civil rights prot ected by the constitution of our country, which means the freedom of t he press in the field of news industry. The liberty of the press is necessary because we can provide the fastest and the m ost accurate public affairs for the public. It can not only m eet the need of citizen s' right, but also achieve the value of news. Freedom of the press is the origin of the human knowledge and wisdom, setting up the bridge of communication between human beings and the press. And is the basis of social supervision by public opinion. Meanwhile, there is a lim it to the freedom of the press, excessive using freedom of the press m ay lead to deviating orb it of our original thought s. What's worse, it brings many negative effects. The understanding of freedom in Montesquieu's m ind is also the premise of a certain legal order and legal constraints, admitting us to do a ll the things which are permitted by the law. Therefore, paying too much attention on this issue makes no difference. The idea of writing of this article is to demonstrate the limits and enjoyments of freedom for argum ent, trying to inductive reasons from phenomena. So we can seek possible solutions about how to solve these problems through legal ways.The article is divided into four parts: the first part from the legal news report at present anomie, emphasizing the distinction between the general anom ie and illega l anomie, and summarizes several typical cases selection model of illegal loss method in news reports; The second part analyses the anom ie of legal news reports from the subjective and objective reasons, such as excessive pursuit of econom ic benefits, news legal system is not perfect in our country; the third part points out the legal responsibility caused by illegal anomie, mainly divided into criminal liability, civil liability and administrative liability; the fourth part is the deep analysis of the causes of anomie of le gal journalism, we should improve the legitim acy of the legal standards of news reports. On the one hand,the protection of the freedom of the press is to encourage the legal news to re port faithfully. On the other hand, appropriate restriction to the freedom of the press aim s to reach balance of guaranteeing and restricting, making legal news reports more standardized, more fair, more can realize its value. |
