Research Of Application Of Production System In Legal Reasoning

Based upon the expert system, this article does research about the theory and method of deductive reasoning of simulating legal provisions by artificial intelligence-producing system, inductive reasoning and learning of cases in order to achieve an expert-prototype system of automatic judgment by legal reasoning.This article bases on using law retrieval or case summarizes in the present computer law application, combines the artificial intelligence methods and legal reasoning, and puts forward a kind of practicable computer legal reasoning method which is conformed to law provisions and legal reasoning in our country. The method of combining the artificial intelligence methods and legal reasoning changes the traditional Legal reasoning way which is used to deductive reasoning or inductive reasoning separately, connects with judicial practice, makes use of deductive reasoning or inductive reasoning together which deductive reasoning is used to retrieval and applicable in law and inductive reasoning is used to induction and learning in legal precedent. Meanwhile, the method takes law as predicate logic, its disassemble for components and applicable consequences, when the case with components to perform the law applicable consequences, the last part of the case knowledge base is found in the same law rules of the reference case.In accordance with the above-mentioned method, the author designs and implements a prototype system of legal reasoning by artificial intelligence. The system takes the code of law as the producing type of law rule base, takes the case fact table as the general database, and takes the case table as the case knowledge base. The system helps the realization of the sentencing standardization and improves the efficiency and quality of legal workers by adopting Microsoft Visual Studio2010as the development tool and SQL Server2008as the background database, which has provided a theoretical and practical basis for the application of artificial intelligence in legal reasoning, and which has achieved some legal effect and social effect.
