Implantation Of The Authority Of The People’s Mediation In Rural Society: Analysis ‘‘the Country Judge” Yang Binsheng At The Perspective Of Sociology Of Law

Affected by market economy and the household registration system, rural society transforms to be a "half acquaintances society”. As traditional authority of clan type is weak and administrative authority is incompatible, rural society needs to be implanted an effective and new authority. The author investigated the chief mediator of people Yang Binsheng, who lives in Luxi town, Xuanfeng county, Pingxiang city, Jiangxi province, which is known as "country judge", and found that the people’s mediator was approved by the villagers and established the status of authority through resolving disputes of rural society timely and effectively, then can lead rural order and renovate rural society effectively relying on their authority. Therefore, the author tries to choose "rural judge " —Yang Binsheng as the research object, uses the method of sociology of law, and demonstrates establishment,value and forming conditions of new authority of rural people’s mediator through on-the-spot interview and case analysis.According to the article, the authority of people’s mediators can offset the lack of rural authority, stabilize the order of rural social and communicate between state and society. It also demonstrates that the formation of authority of rural mediators needs institutional guarantee, local color, fair, work skills and charm of personality, then provides view on the replication of authority of rural mediators.
