China ICT (information and communications technology) is one of the high-techindustries with the earliest system reforming, the highest level in marketization, as wellas the strongest international competitiveness. With respect to China’s12th five-yeardeveloping planning, China ICT industry will meet a new period with more strategicopportunities led by the cloud computing technology and physical network technology,and will have a broader development prospects. But China ICT enterprisers werefrequently restricted by the patent barriers of the developed country in theinternationalization process. China enterprises have got nearly more than800traderemedy investigation cases in the2001-2012, and rank first in all countries of theworld. The technical barriers of trade have become to be the main obstacle for China’sICT exports. Under these circumstances, this paper hereinafter take " the patentbarriers and breakthrough strategies of the internationalization for ICT latecomerenterprises” as the research topic, integrated with analysis to the global ICT industrydevelopment status, as well as case study of ZTE and HUAWEI corporation in thedevelopment of technical capabilities and intellectual property strategy, trying toexplore and validate a feasible reality path that ICT latecomer enterprises in Chinabreak through the patent barriers of the developed countries and catch up with thedeveloped countries industry level with the help of disruptive innovation technologyand corresponding intellectual property strategy.Research has revealed that ICT industry has an attribute of network externalities,which provides the ICT latecomer enterprises with opportunities to break up thevicious cycle and achieve enormous development. Developing countries make use ofrevolutionary disruptive innovation technology and intellectual property strategy tobreak up the previous industrial chain layout. Not only could break throughinternational patent barriers, but also overpass and reverse the market pattern of thesame generation in the life cycle to reduce the competitive gap.Otherwise, the networkeffect will further expand the gaps between forerunner and latecomer. This conclusionhas filled up with blank of the previous research in developing countries technical ability evolution and innovation mode for the existing literature.The case of ZTE GSM multicarrier base station innovation, and Huaweidistributed base station innovation have brought strong hit and impact on the globalcellular mobile communication industry. This essay will try to offer theoreticalacademic interpretation and analysis for the two cases, and make more Chinesehigh-tech enterprise to catch up with the international level and occupation of thecommanding heights of the intellectual property of the ICT industry, getting rid of therestriction of patent barriers.
