Case Study Of The Medical Dispute In One City

ObjectiveFrom the study on the87examples of medical dispute happened in one city of Jiangsu in2011, we classified the practical work on argument about medical treatment, analyzed the factors in social, medical, and patient causing medical disputes, compared the proportion distribution among those factors. We also analyzed the specialty distribution and the main cause of medical dispute in the hospital then put forward countermeasure which could prevent medical dispute from happening and also create a better environment for the medical practice.MethodsRetrospective study of87cases of technical identification of medical malpractice in one city of Jiangsu in2011, counted the distribution of specialty, identification results, etc. Those cases we mentioned involved15specialties. Disputes in operation department are mainly about surgery and obstetrics, while internal medicine play a main role in the non-operation departments. In the87identifications, among the conclusions reached by experts,25cases should be medical negligence, while the other62should not. The negligence rate is28.73%.ResultsAccording to the data analyzing the main cause for medical disputes, we found that, firstly, the communication between doctors and patients is not enough and information is asymmetric. There is an intrinsic contradiction between the expectations of patient and the medical risks, causing disputes and lead to an upward occurrence trend of the medical disputes in recent years. In the part of hospital management, the slack management, such as practice out of permission, less standardized diagnosis and treatment, seldom coordination between departments, give an easy rise to the occurrence of medical disputes. The slack management related to the medical staffs’ attitude to a certain extent, which contains lack of awareness, irregular work style, insufficient estimates for patient’s condition, would have a bad effect to the reputation of a hospital. In macro, with the reform of medical insurance system, the problems such as difficult and expensive medical treatment, show an imbalanced deployment of medical resource in current situation. At the same time, with the development of social economy, the pursuit for efficiency and benefit has become the primary goal of the hospital. While the economic benefit comes first rather than medical quality, some medical institutions choose to conceal the facts. This protected the personnel and hospital’s reputation apparently, but in fact it will lead to the increase of medical treatment dispute that would further cause the deterioration of the situation of medical dispute. Recognizing the main reasons of the medical disputes, aimed at the various factors, we put forward follow effective solutions. To the hospital, seeing irregular treatment being the main cause, it is necessary to strengthen the education about law and skills and improve the management of hospital comprehensively on medical treatment quality and illness record to meet the requirement of new laws and regulations. At the same time, the construction of doctor-patient trust relationships is also important to reduce medical dispute, such as improving the medical workers’ consciousness of service and quality, making them sticked to the knowing-unification regulation, strengthening the communication between the patients and medical workers, building and consummating the medical risk guarantee system, attempting to publicize the medical undertaking, could also play a positive role in reducing the occurrence of medical disputes.ConclusionAfter studying and counting the87examples of technical appraisal for the medical negligence in one city of Jiangsu province, analyzing the distribution of medical specialty and the primary cause of those medical dispute, we reached conclusions that:1. Theoretically, the contradiction between doctor and patient actually reflects how the limited modern medical science combat with the immeasurable demand that the patients have for health. So probably, this contradiction could only be remitted instead of dispelled and will continually exist, passing through the human’s history.2. There’re varied causes for medical dispute which indeed contain the factors in healthcare and medicine, patients and also the society. In brief, there’s a rising occurrence frequency of medical dispute in front of us, owing to diverse causes and factors.
