| Juvenile delinquency, which is called as the third biggest public hazard, has beenpuzzling the world. Statistics show that juvenile delinquency, bearing the flaringtendency, has accounted for one third of all the criminal cases in China. Juveniledelinquency is referred to such activities as is committed by minors, over the age offourteen but under eighteen, who violate criminal laws and should suffer the criminalpunishment. Based on the analysis of the juvenile delinquency actuality, itscharacteristics and developing trend, as well as drawing on the relevant experiences athome and abroad, this thesis aims to find out the cause of juvenile delinquency andcarry out the countermeasure research on prevent-and-controlling juveniledelinquency from such perspectives as law, society and individual.The reasons ascribed for juvenile delinquency lie in the two main aspects: First----individual. It includes the individual’s biological and values aspect.Second----society.1) The family changes, which contains the increasing number ofmigrant workers moving to town; the appearance of more and more divorced andsingle-parent families because of number of divorce significantly increased;competition increasing cause parents waste education of their children.2) Extensionof social animosity, which contains two class polarizations of wealth and positionincreases social animosity; economic benefits are deprived, which causes difficulty onrights maintenance.3) Negative impacts of internet. Negative information frominternet impacts the psychology of the juvenile. It also causes juvenile delinquency.As for prevent-and-controlling the juvenile delinquency, this thesis puts forward thefollowing countermeasures: prevent-and-controlling of the law, society and individualshould be carried out together while “prevent” is highlighted. Regarding to the minorswho commit crimes, it should be better to set their inferior quality right rather thansimply investigate criminal liability. |
