Juvenile Delinquency Survey Reports From2008-2012of Yibin Municipality In Sichuan Province

With the deepening of reform and opening-up, the rapid development of the economy and the great changes of social structure, juvenile delinquency show high momentum. Growing juvenile delinquency has a direct impact on the healthy growth of a generation and causes serious harm and misfortune to the society, families and individuals. Faced with the serious challenges of the high incidence of juvenile delinquency, in order to recognize the basic situation of juvenile delinquency, author investigate the juvenile delinquency in an area, hoping to understand the specific characteristics of juvenile delinquency and the causes in that region, and on this basis put forward the feasible proposals as a certain reference for the prevention of juvenile delinquency.This report has22,000words, includes five parts:The first part discusses the purpose and significance of the survey.The significance of this survey is that it can provide a reference for the criminal legislation on juvenile, to some extent, to enrich the areas of criminology, and also provide material for the study of behaviors of the juvenile and psychological conditions and the intrinsic link between the two. Through the survey and the analysis of the characteristics of juvenile delinquency and its changes, we are better able to grasp the characteristics and laws of juvenile delinquency, so as to propose appropriate preventive measures to effectively control and reduce juvenile delinquency.The second part introduces the methodology of the survey. The survey selected juvenile delinquency of Yibin in Sichuan province in the last five years as a research object. During July9,2012to July12,2012, the author investigated through visiting Intermediate People’s Court, Procuratorate, the Municipal Public Security Bureau, Juvenile Correctional Facilities and other related units. The specific methods of investigation include the docket investigation, interviews and case tracking method.The third part is the results of the investigation. From2008to2012, juvenile delinquency in Yibin has the following characteristics:1. The number of the criminal cases by juvenile each year was more than thousands, and was increasing year by year. 2. Every year, the total number of juvenile offenders maintained growth, the number of14to15year-old and17to18year-old juvenile offenders fluctuated, the number of15to16year-old and16to17year-old juvenile offenders was increasing every year, especially the number of16to17year-old juvenile offenders increased rapidly, to2012, it had became the largest proportion of all.3. The type of criminal cases of juvenile in a total of21species, mainly property crimes, supplemented by violent crimes, a small amount of sex crimes, as well as a handful of other types of crime.4. The educational level of the juvenile offenders were generally low, the vast majority was primary or junior middle school education, the number of juvenile offenders with high school and above education level was very few, and there were a handful of illiteracy.5. Juvenile offenders are mostly from rural areas, the rural juvenile offenders not only quantity, but also maintained growth. The number of juvenile offenders from urban was relatively stable and gradually declined in the proportion of the total number of juvenile offenders. The number of juvenile offenders from small towns was very small, but in recent years, had a fast growing in both the number and the proportion of the total number.6. Most juvenile offenders had no formal works; in addition, many juvenile offenders were farmers of migrant workers or farmers farming at home. Small proportion of juvenile offenders had a formal job or in school.7. Juvenile generally committed the crime alone or two or three, the situation of many juvenile involved in one case was not infrequent in juvenile delinquency.The fourth part is analysis and discussion. This part divides into two parts, the overall analysis and specific analysis.From the overall analysis, the deteriorating situation of juvenile delinquency in Yibin resulted from the interacting of social, school, family and juvenile themselves, but the most fundamental reason was the neglect impact of socio-economic development, and another reason was the law of the own cyclical variation of juvenile delinquency. During the investigation, the author found that, juvenile delinquency in Yibin historically presented the cyclical fluctuations of "growth-peak-down-trough-growth", which because the social managers not paid enough attention to juvenile offenses, only took corresponding measures when juvenile delinquency was serious. This treatment of juvenile delinquency leads to the cyclical variation of juvenile delinquency, and the juvenile delinquency in Yibin in the last five years just in the growth segment of the fluctuations, so there has been increasing year by year. Specific analysis divided into three aspects, including the subject of crime, crime type and form, re-offending situation analysis.The fifth part is conclusions and recommendations. It can be seen through the investigation, juvenile delinquency situation in Yibin is serious, and the work to prevent juvenile delinquency should be strengthened. The above mentioned characteristics of the juvenile delinquency in Yibin is caused by a variety of reasons, including the imbalances of regional economic development, the indifference of the administrative department, the spread of the social misfits culture and a serious shortage of legal education. Therefore, to prevent juvenile delinquency, the government, schools, families, and society need to function as a whole. Facing with the reason and the feature of juvenile delinquency, author proposes a few suggestions for the prevention of juvenile delinquency:1.Improve the quality of family education, to help the juvenile form a gentle, cheerful and frank character, in order to avoid the influence of criminal incentives;2.Emphasis on legal education in primary and secondary schools, develop the concept of the rule of law to prevent juvenile from ideological life of crime;3.Raise the level of economic development, narrow the gap between rich and poor, and broaden employment channels, promote urbanization process steadily, this is an effective way to solve the problem of juvenile delinquency from the source;4.Create a good social environment, which is a necessary condition for the healthy growth of juvenile, and which also helps to reduce the possibility of juvenile to commit a crime;5.Establish the community correction system for juvenile offenders, to help them reintegration;6.Improve the criminal record of juvenile sealed and elimination system, further implement the protection of juvenile. In short, the prevention of juvenile delinquency is a systematic project, needs the concerted efforts of families, schools and society.
